本科论文摘 要因为科技金融的发展，实体经济需求也随之发生变化，货币形态虚拟化、数字化已经成为一个重要的发展方向，由此,数字货币开始出现在公众的视野。但是由于数字货币本身具有的去中心化、匿名性等特点，给法律法规带来了巨大的风险与挑战。本文研究数字货币的概念与特点，以及数字货币所带来的诸多风险与法律问题，例如法律定位模糊、相关的法律制度缺失等。而后针对本文所论述的困境，积极寻求数字货币法律监管问题的应对之策，避免被不法分子使用数字货币进行违法犯罪行为，危害社会。使得数字货币可以健康发展，并维护金融秩序的稳定。关键字：数字货币，比特币，法律监管本科论文Abstract Because of the development of technology and finance, the demand of the real economy also changed, and the virtualization and digitalization of currency have become the most important development situation, thus digital currency appeared. However, due to the decentralization and anonymity of digital currency, it brings great risks and challenges to laws and regulations. This article study the concepts and features of digital currency, as well as many risks and legal issues that come with digital currency, such as the legal position of fuzzy, lack of relevant legal system and so on. And then according to this article discussed the plight of actively seeking the solution of digital currency regulation of law, to avoid being criminals using digital currency for illegal and criminal behavior, harm to society.
