<>DecreeNo.70oftheChairmanofthePeople’sRepublicofChinaPromulgationDate:29thJune2002EffectiveDate:1stNovember2002Promulgatedby:TheNinthNationalPeople’sCongressTableofContentsChapterI.GeneralPrinciplesChapterII.ProductionSafetyGuarantiesforProductionOperationUnitsChapterIII.TheRightsandObligationsoftheEmployeesChapterIVTheSupervisionandAdministrationofProductionSafetyChapterVEmergencyRescueforanAccidentandItsInvestigationandDisposalChapterVILegalLiabilityChapterVIISupplementaryRulesChapterIGeneralPrinciplesArticle1Inordertostrengthenthesupervisionandadministrationofproductionsafety,topreventandreducetheaccidents,toguaranteethepeople’slifeandpropertysafety,andtopromotetheeconomicdevelopment,thislawisherebyenacted.Article2ThisLawshallapplytotheproductionsafetyinvolvingtheunitsengagedinproductionoperationswithintheterritoryofthePeople’sRepublicofChina(hereinafterreferredtoasthe“productionoperationunits”).Therelevantlawsandadministrativeregulationsconcerningfireprotectionsafety,roadtrafficsafety,railwaytrafficsafety,marinetrafficsafetyandcivilaviationsafetyshallalsoapplyifavailable..Article3Theadministrationofproductionsafetyshallcomplywiththeguidelineof“safetyandprecautionfirst.”Article4ProductionoperationunitsshallabidebythisLaw,otherlawsandadministrativeregulationsonproductionsafety,strengthenthecontroloverproductionsafety,establishandperfectliabilitysystemofproductionsafety,improvesafetyconditions,andensureproductionsafety.Article5Thepersonnelchieflyinchargeofproductionoperationunitsshalltakeoverallresponsibilityfortheirownproductionsafety.Article6Theemployeesofproductionoperationunitsshallobtaintherightofguaranteeingtheproductionsafety,andmeanwhilefulfilltheobligationsasregardsproductionsafetyaccordingtolaw.Article7TheLaborUnionshallcallontheemployeestoparticipateindemocraticmanagementandsupervisiontosafeguardthelawfulrightsandinterestsinthematterofproductionsafety.Article8TheStateCouncilandlocalpeople’sgovernmentsatalllevelsshallstrengthentheguidanceofproductionsafetywork,supportandoverseealltherelevantdepartmentstofulfilltheirresponsibilityforsafetycontrolandsupervisionaccordingtolaw.Article9TheStateCouncildepartmentinchargeofthecontrolandsupervisionofproductionsafetyshallcarryouttheoverallsupervisionandadministrationofproductionsafetythroughoutthenationaccordingtolaw;thedepartmentsofthepeople’slocalgovernmentsatandabovethecountylevelinchargeofthecontrolandsupervisionofproductionsafetyshallaccordingtolawcarryouttheoverallsupervisionandadministrationofproductionsafetywithintheiradministrativedivisions.AccordingtothisLawandtheprovisionsofotherlawsandadministrativeregulations,thedepartmentsconcernedintheStateCouncilshallcontrolandoverseetheproductionsafetywithintheirownresponsibilityrange;thedepartmentsconcernedinthelocalpeople’sgovernmentsabovethecountylevelshallcontrolandoverseetheproductionsafetywithintheirindividualresponsibilityrangeinaccordancewiththisLawandtheprovisionsofotherlawsandadministrativeregulations.Article10TheStateCouncildepartmentsconcernedshallaccordingtolawconstituteforthwithnationalstandardsortradestandardsbasedontherequirementsofproductionsafetyguaranties,andmaketimelyrevisionsinthelightoftechnologicalandeconomicdevelopment.Productionoperationunitsshallcarryoutthen...
