网络隐私权保护研究ResearchonNetworkPrivacyProtection摘要随着信息的进步、网络技术的快速发展，给人们带来了区别于传统的全新的生活方式。但是由于互联网和社交网络的广泛应用下，公民隐私权的保护出现了新问题，人们对网络环境下的隐私权的关注也越来越多。我国有关部门对中国互联网络发展状况进行了统计，自互联网技术发展以来，数据统计时间截至2020年12月，我国网民数量呈现大幅度上升的趋势，高达9.891亿，较2020年3月增长8540万，互联网普及率达70.4%。通过报告可以看出，我国网络用户数量激增，尤其是在新冠疫情的影响下，人们也更多的使用网络获取最新消息，对于网络的使用也越来越频繁。互联网的用户群体不断扩大，在网络技术的发展下，在网络平台中获取他人隐私也跟更加容易。在互联网传播快、影响范围广的特点下，一旦发生上述现象造成的后果是无法挽回的。因此为了避免公民的隐私权受到侵犯的风险越来越大，公民的隐私得不到有效的保障的背景下，迫切需要完善现有法律法规从而建立我国网络隐私权的保护体系。本文主要使用比较分析法和实证分析法。首先从隐私权的内涵出发，在此基础上学习国内外学者的观点，达到对网络隐私权概念的清晰认知，并对网络隐私权的性质特点进行分析以便更好的掌握网络隐私权的基本理论。其次了解国内外关于网络隐私权的研究与发展，根据我国网络隐私权保护现状，对网络隐私权保护存在的问题提出自己的观点。文章最后从立法保护、执法完善、司法保护等方面提出对我国网络隐私权保护的建议。关键词：网络隐私权；隐私权；立法保护PAGE\*MERGEFORMATIVAbstractWiththeprogressofinformationandtherapiddevelopmentofnetworktechnology,itbringspeopleabrand-newlifestylewhichisdifferentfromthetraditionalone.However,duetothewidespreadapplicationoftheInternetandsocialnetworks,newproblemshaveemergedintheprotectionofcitizens'privacyrights,andpeoplearepayingmoreandmoreattentiontoprivacyrightsinthenetworkenvironment.The47thStatisticalReportonInternetDevelopmentinChinashowsthatasofDecember2020,thenumberofInternetusersinChinahasreached989.1millionthatis85.4millionlargerthanthatinMarch2020,andtheInternetpenetrationratehasreached70.4%.ItcanbeseenfromthereportthatthenumberofInternetusersinChinahasincreasedsharply,especiallyundertheinfluenceoftheCovid-19wherepeopleispronetousingInternetforobtainingthelatestnews,thustheuseoftheInternetisbecomingmoreandmorefrequent.Inthisway,thenumberofInternetusersisgrowing,anditbecomeseasiertoobtaintheprivacyofothersonthenetworkplatformwiththeapplicationofnetworktechnology.DuetotherapidspreadoftheInternetandwideinfluencerange,theconsequencesareseriousoncetheprivacydisclosureoccurs.Hence,inordertoavoidtheincreasingriskofinfringementofcitizens'privacyrightsandtoprotectcitizens’privacy,itisurgenttoimprovetheexistinglawsandregulations,whichiseffectivetoestablishtheprotectionsystemofChina'snetworkprivacy.Thisarticlemainlyusescomparativeanalysisandempiricalanalysis.First,proceedingfromtheconnotationoftheprivacyrightthatservesasabasistolearntheviewsofdomesticandforeignscholarstoachieveaclearunderstandingfortheNetworkPrivacy,andthenanalyzethecharacteristicsoftheNetworkPrivacytobettergraspthebasicstheory.Secondly,tounderstandbothdomesticandoverseasresearchofNetworkPrivacyrights.BasedonthecurrentsituationofnetworkprivacyprotectioninChina,myownviewsontheproblemsofnetworkprivacyprotectionareputforward.Finally,thepapergivessomesuggestionsontheprotectionofnetworkprivacyinChinafromtheaspectsoflegislativeprotection,lawenforcementimprovementandjudicialprotection.Keyword:NetworkPrivacyRight;PrivacyRights;LegalProtection.PAGE\*MERGEFORMATIV目录TOC\o"1-3"...
