I论刑法中的交通肇事逃逸摘要随着社会的进步和交通运输业的不断发展，交通事故的数量也在迅速增加。交通肇事逃逸不仅严重危及受害人的生命健康，而且影响司法责任的追究。交通运输业取得了长足的进步，全国汽车保有量也在不断增加，交通事故案件也逐年增多。这些事故案例的出现，给人们的生活和健康带来了巨大的威胁，其中一些人选择逃离，担心事故发生后承担相应的责任。异议司机的出现，使得交通事故责任的确定变得更加困难。交通事故作为一个实践中难以有效遏制的常见疑难案件，对人们的伦理道德构成了严重的挑战。在依法保护公民人身权和财产权日益增多的背景下，刑法作为一部部门法应予以回应。尽管《刑法》和《最高法院司法解释》有相关规定，但对交通肇事逃逸的争议性问题仍有研究和探索的必要。现行法律对于肇事者在交通肇事后逃逸的给予严惩，在考虑如何认定“逃逸”并且如何在实务中根据行为人的具体情况作出不同判断，在实践中寻找切实处理交通肇事“逃逸行为”的具体方法，便于大众理解并对于在发生交通事故后减缓行为人恐惧心理主动采取措施，接受法律，接受处理意见，减少“逃逸”，避免产生伤者不能得到及时救助的后果，使得行为人主动采取救助义务，促进社会和谐发展。第一部分对交通肇事逃逸行为的概念进行了阐述；第二部分对交通肇事逃逸的性质进行了分析，并详细论述了定罪条件与一般加重处罚的条件以及逃逸致人死亡；第三部分具体分析了逃逸构成条件；第四部分是逃逸与其他犯罪的界限等问题。关键词：逃逸；交通肇事罪；逃逸致人死亡；救助义务IIABSTRACTWiththeprogressofsocietyandthecontinuousdevelopmentoftransportationindustry,thenumberoftrafficaccidentsisalsoincreasingrapidly.Trafficaccidentescapenotonlyseriouslyendangersthelivesandhealthofvictims,butalsoaffectstheinvestigationofjudicialresponsibility.Transportationindustryhasmadeconsiderableprogress,thenumberofautomobilesinChinaisalsoincreasing,andthenumberoftrafficaccidentcasesisincreasingyearbyyear.Theemergenceoftheseaccidentcaseshasbroughtgreatthreattopeople'slifeandhealth.Someofthemchoosetoflee,fearingthattheywilltakecorrespondingresponsibilityaftertheaccident.TheemergenceofYiyidriversmakesitmoredifficulttodeterminetheliabilityfortrafficaccidents.Trafficaccidents,asacommonanddifficultcasethatcannotbeeffectivelycurbedinpractice,poseaseriouschallengetopeople'sethicsandmorality.Underthebackgroundofincreasingprotectionofcitizens'personalandpropertyrightsbylaw,criminallawshouldberespondedasadepartmentlaw.DespitetherelevantprovisionsoftheCriminalLawandtheJudicialInterpretationoftheSupremeCourt,itisstillnecessarytostudyandexplorethecontroversialissueofescapingfromtrafficaccidents.Thecurrentlawseverelypunishestheperpetratorswhoescapeafteratrafficaccident,considershowtoidentifythe"escape"andhowtomakedifferentjudgmentsaccordingtothespecificsituationoftheperpetratorsinpractice,andseeksconcretewaystodealwiththe"escapebehavior"oftrafficaccidentsinpractice,soastofacilitatepublicunderstandingandtakeactivemeasurestoalleviatetheperpetrators'fearafteratrafficaccident.Toimplement,acceptthelaw,acceptthetreatmentopinions,reduce"escape",avoidtheconsequencesthattheinjuredcannotbetimelyrescued,sothattheactorstaketheinitiativetotaketheobligationofrescue,andpromotetheharmoniousdevelopmentofsociety.IIIThefirstpartexpoundstheconceptofhit-and-runbehavior;Thesecondpartanalyzesthenatureofhit-and-run,anddiscussesindetailtheconditionsofconvictionandgeneralaggravatedpunishment,aswellasthedeathcausedbyhit-and-run.Thethirdpartanalyzestheconditionsofescape;Thefourthpartisabouttheboundarybetweenescapeandothercrimes.Keywords：Escape;Trafficaccide...
