摘要南海是我国海上战略的重要支点，其具有丰富的海洋资源，也成为周边国家不断侵扰的对象，如何维护南海权益成为我国急需解决的问题。本文主要以文献研究法搜集我国南海的发展历程，明确南海权益的范围，以此为我国南海合法权益提供历史性和法理性证据。同时，本文呈现了我国与菲律宾、越南等国的南海争端、国际方面对南海基准线——九段线的质疑和挑战以及国内对南海维权不足现状，表明了南海维权方面受到多方面的挑战。在此基础上，本文从多个角度提出南海维权策略，我国可以优先通过外交手段与他国沟通，利用国际法维护自身的合法权益，也应加强国内海洋法律建设，为南海维权提供坚实的法律后盾。在维权的同时，我国还应注重对南海的管理和开发，以三沙市为代表，合理协调和规划南海的行政管理，主张搁置争议，在保护生态环境的前提下共同开发南海资源。南海维权势在必行，中国需要通过多种手段维护南海的合法权益，保障我国的海防安全。关键词：南海；海洋权益；维权现状；维权策略AbstractThesouthChinaseaisChina'smaritimestrategyimportantfulcrum,ithasrichMarineresources,alsobecometheobjectofsurroundingcountriesharass,howtomaintaintherightsandinterestsofthesouthChinaseatobecomeourcountryurgentlyneedstosolvetheproblem.ThispapermainlycollectsthedevelopmenthistoryofthesouthChinaseabythemethodofliteratureresearch,clarifiesthescopeofrightsandinterestsinthesouthChinasea,soastoprovidehistoricalandlegalevidenceforthelegitimaterightsandinterestsinthesouthChinasea.Atthesametime,thispaperpresentedinChinaandthePhilippines,VietnamandothercountriesofthesouthChinaseadispute,theinternationalaspectsofthebaselineofthesouthChinasea-ninesectionofthelineofquestioningandchallengesaswellasthedomesticpresentsituation,theshortcomingsoftherightsofthesouthChinaseashowsthattherightsofthesouthChinaseaundervariouschallenges.Onthisbasis,thispaperputforwardtherightsofthesouthChinaseastrategyfromvariousangles,canprioritythroughdiplomaticmeanstocommunicatewithothersinourcountry,usinginternationallawsafeguardthelegitimaterightsandinterestsoftheirown,shouldbetostrengthentheconstructionofdomesticMarinelaw,providesolidlegalbackingfortherightsofthesouthChinasea.Inhumanrightsatthesametime,ourcountryshouldalsopayattentiontothemanagementanddevelopmentofthesouthChinasea,representedbythreeshashi,reasonablecoordinationandplanninginthesouthChinaseaadministration,arguesthatthestory,onthepremiseofprotectingtheecologicalenvironmenttodeveloptheresourcesofthesouthChinasea.ItisimperativeforChinatosafeguarditslawfulrightsandinterestsinthesouthChinaseathroughvariousmeansandsafeguardChina'smaritimesecurityKeywords:SouthChinaSea;Maritimerightsandinterests;Humanrightssituation;Rightsprotectionstrategy第1章绪论1.1选题来源近些年，南海海域风云突起，越南、菲律宾等国家对南海虎视眈眈，不断侵扰我国南海区域，2012年4月，中菲在黄岩岛发生激烈地对峙，2014年，越南干扰南海钻井平台的建设。南海周边国家在我国南海区域挑衅滋事，侵害我国南海海洋权益。此外，美国、日本等域外大国不断干扰南海问题解决，尤以美国为最。美国于2014年4月28口签署了《菲美加强防御合作协议》，2015年，美国的舰船等频繁地出现在南海区域，甚至在2016年违反中国法律擅自进入中国南海的西沙群岛海域，并且与菲律宾、越南等国频繁开展军事互动。面对严峻的南海局势，中国从法律和军事等方面维护南海权益势在必行。海洋被誉为“蓝色动脉”，海洋权益是国家繁荣强盛的重要指标。南海海洋资源丰富，对促进国家海上贸易和经济发展具有一定作用。南海在海洋航道中居于重要位置，关系着海洋国际贸易的往来。同时，南海又处于中国海洋战略占据重要地位，对南海海洋权益维护具有重要价值。如何证明南海...
