论文题目： 比特币交易的法律问题研究 中文摘要比特币是网络化的、数字货币的一种形式，它完全是电子化的，不受任何主权机构和个人的控制，也不能被复制。它的出现，是一种全新的数字加密货币的大胆尝试，同时也是对“非国家化货币”这种信念的传承。而在比特币交易风潮席卷全球时，对传统的法律制度和金融体系都带来了巨大的挑战。本文通过对比特币的产生及发展现状进行考察，分析比特币有关的特征、法律属性以及比特币交易的过程、特征，以此探讨比特币交易存在的法律问题，如比特币交易法律监管缺失、交易者发生纠纷后维权无门等；同时提出目前比特币交易中遭遇的法律困境，如举证、取证、证据保全等；最终提出提高比特币交易平台的市场准入机制、建立健全相关法律制度、明确比特币交易各方责任、建立和完善电子证据保全制度以及推动建立比特币国际纠纷解决机制的五个方面建议，以期对我国比特币交易的法律规制有所裨益。关键词：比特币，虚拟财产，交易平台，法律监管，法律规制I ABSTRACTBitcoin is a networked, digital currency form that is completely electronic and is not under the control of any sovereign body or individual nor can it be copied.
