探讨植物新品种侵权行为和法律责任 ［摘要］ 植物新品种权是一种新的知识产权。因为植物新品种是在完全开放的大田条件下选育、审定、检测、生产的，所以，极易遭到侵犯。我国现有法律虽对侵犯植物新品种权的行为和法律责任作了规定，但既不全面又欠力度。为更好地保护植物新品种权，本文对侵犯植物新品种权的行为及其法律责任，进行了探讨。 ［关键词］ 植物新品种权；侵权行为；法律责任。 ［Abstract］ The right of the new plant variety is a new kind of intellectual property . Plant variety is easily infringed,because it is selected to nurture,revise, inspect and produce on the terms of completely opening lands for growing field crops. Though the current law made regulations on the behavior and intellectual property of infringing the plant variety right , it still is not comprehensive and lacks order to protect the plant variety better,this article discusses on the behavior and intellectual property of infringing the plant variety right .［KEY WORDS］ the Right of the New Plant .Legal Responsibility.植物新品种权，是品种权所有人对其授权品种享有的排他的独占权；在国内、外都属于一种新的知识产权。对品种权保护的现状是，在理论上讨论不透、司法实践经验不足、法律法规不健全、执法和司法保护不力。我国虽然颁布了《植物新品种保护条例》(以下简称《条例》)、《农业植物新品种保护条例实施细则》和、《农业植物新品种权侵权案件处理规定》、《最高人民法院关于审理植物新品种纠纷案件若干问题的解释》和《最高人民法院关于审理侵犯植物新品种权纠纷案件具体应用法律问题的若干规定》等法律法规，规定了侵犯品种权行为的种类及其法律责任，但规定的不全面、对品种权保护力度仍然不足。所以，有必要对侵犯品种权的行为及其法律责任，进行深化探讨。一、侵犯品种权行为的概念。侵犯品种权，是指品种权人享有的受我国法律保护的有效的品种权遭到某种违法行为的侵害。侵犯品种权的行为，是指未经品种权人许可，生产或者销售授权品种的繁殖材料，或者将授权品种的繁殖材料重复使用于生产另一品种的繁殖材料，以及假冒授权品种的繁殖材料的行为。生产授权品种的繁殖材料，是指使用授...
