本科毕业设计-海运提单的风险与防范措施探析

AbstractThere is a close relationship between international trade and maritime law.If there is wrong dealing in shipping,the legal interests of the trades will be seriously affected.In the practice of international trade ,B/L is one of the most important shipping documents in the international trade.The froms of maritime fraud relating to the B/L vary,such as backdated and advanced B/L,a letter of indemnity in exchange omission of B/L,a forged B/L,and release the goods without any documents. Based on the B/L risk as the main line ,puts forward the prevention and relief B/L measures to target.This paper firstly analyzes the role of B/L,then summarized the B/L risk types of forms,according to different forms of B/L risk,the risk of summary B/L corresponding to the formation of the proposed precautions and relief measures,to international ocean B/L affirms the positive singnificance of carriage of goods by sea.Keywords: B/L ； risk prevention ；relieve海 运 提 单 的 风 险 与 防 范 措 施 探 析海 运 提 单 是 现 代 海 上 运 输 和 贸 易 环 节 中 重要 的 运 输 单 证 。 然 而 随 着 国 际 贸 易 和 海 上 运输 的 不 断 进 展 ， 提 单 诈 骗 所 带 来 的 风 险 和 损失 也 日 趋 严 重 。 涉 及 金 额 动 辄 几 百 万 甚 至 上千 万 ， 往 往 造 成 巨 大 的 损 失 甚 至 使 企 业 破 产。尤 其 对 于 进 展 中 国 家 ， 因 为 缺 乏 航 运 和 贸 易方 面 的 经 验 和 知 识 ， 因 此 很 容 易 成 为 提 单 诈骗 的 受 害 者 。 我 国 是 最 大 的 进 展 中 国 家 ， 自从 实 现 改 革 开 放 以 来 ， 对 外 贸 易 对 经 济 建 设作 用 十 分 突 出 。 但 由 于 缺 乏 国 际 贸 易 和 海 运操 作 知 识 和 经 验 ， 我 国 的 一 些 对 外 贸 易 公 司往 往 成 为 提 单...
