论难民的法律保护[摘 要] 难民问题一向都是国际社会上的热点话题，2015 年欧洲的难民数量急剧上升，地区冲突的不断扩大造成了严重的难民危机。现阶段难民法律保护的立法与实践存在着缺陷，合法有效的保护难民需要国际社会的共同努力。既要从难民的输出国出发，帮助他们稳定社会秩序以减少动乱与不安。也需要国际社会齐心协力，共同完善难民法律保护的实施机制。[关键词] 难民；法律保护；实施机制[Abstract] The refugee problem has always been a hot topic in the international community. In 2015 ， the quantity of refugees has risen sharply in Europe, follow by it, the regional conflict has been expanding which creating a serious refugee crisis. At present, the legislation and practice of refugee legal protection are flawed. The legal and effective protection of refugees requires the joint efforts of the international community. It is necessary to proceed not only from the refugee-exporting countries, to help them to stabilize social order, to reduce unrest and anxiety; but also need international countries to work together to improve the implementation of refugee legal protection mechanism. [Key words] Refugee ； Legal protection ； Enforcement mechanism一、 难民的界定与分类（一）难民的定义最初，世界上只有少量难民，因此并没有得到国际上的重视。在第一次世界大战之后，欧洲的各大同盟阵营开始相继瓦解，新的国家政治格局造成了大量的难民涌现，难民问题终于得到了关注。国家联盟为解决这个问题，成立了难民事务高级专员，规定了难民的定义，即特定来源国的逃亡者。在适用中因受到地域化的限制，使得难民事务高级专员在世界范围内无法发挥作用。“难民”这一词来源于法语，国际上的难民的定义分为狭义难民和广义难民。狭义难民是指“公约难民”，是指联合国 1951 年《关于难民地位的公约》界定的难民：一切有正当理由畏惧由于种族、宗教、国籍、属于某社会团体或具有某种政治见解的原因受迫害，而留在其本国之外，并且由于此项畏惧，而不能或不愿意受该国保护的人。广义难民是指“章程难民”，是联合国难民署根据其《章程》所认定为...
