CodeofOccupationalDiseasePreventionofPRC(FORREFERENCEONLY)No.60OrderbyPresidentofPRCTheCodeofOccupationalDiseasePreventionofPRC,adoptedinthe24thSessionoftheStandingCommitteeoftheNinthPeople’sCongressonOctober27,2001,isnowpromulgatedforenforcementfromMay1,2002.JiangZemin,PresidentofPRCOctober27,2001CodeofOccupationalDiseasePreventionofPRC(Adoptedinthe24thSessionoftheStandingCommitteeoftheNinthPeople’sCongressonOctober27,2001)ContentChapter1GeneralArticle1ThisCodeisenactedinaccordancewiththeprovisionsoftheConstitutioninabidtoprevent,controlanderadicateoccupationaldiseases,preventoccupationaldiseases,protectthehealthandtherightsoflaborersandboosteconomicdevelopment.Article2ThisCodeappliestotheoccupational-disease-preventionactivitieswithintheterritoryofPRC.“Occupationaldisease”hereunderreferstothediseasesincurredtothelaborersofenterprises,institutionsandprivatebusinessunits(hereinafterreferredtoas“Employer”)resultedfromcontactingwithpowderdust,radioactivesubstances,otherpoisonousandharmfulsubstancesinthework.Thepublicheathauthoritiesandthelabor&socialsecurityauthorityundertheStateCouncil(willenact,adjustandpromulgatethecategoriesandcatalogsofoccupationaldiseases.Article3Thepreventionofoccupationaldiseasesshouldfollowtheguidelineofpreventionfirstandprevention&treatmentcombination,andstandtothecategorizedmanagementandcomprehensivetreatment.Article4Laborersareentitledtooccupationalhealthandoccupationprotectioninaccordancewiththeapplicablelaws.TheEmployershallcreatetheworkplaceandconditionsincompliancewiththestateoccupational-healthstandardandrequirement,andtakeappropriatemeasurestoensureoccupationalhealthandoccupationalprotection.Article5TheEmployershallputintopracticethewell-structuredresponsibilitysystemforoccupationaldiseaseprevention,strengthenthemanagementontheoccupationaldiseaseprevention,elevatethelevelofoccupationaldiseasepreventionandbeliableforthein-houseoccupationaldiseases.Article6TheEmployershalleffectthepolicycoveringthework-relatedinjuriesaccordingtoapplicablelaws.ThelaborandsocialsecurityauthorityundertheStateCouncilandcounty-abovepeople’sgovernmentsshouldstrengthenthesupervisionandmanagementofthesocialsecuritycoveringwork-relatedinjuriesinanefforttoguaranteelaborers’legalrightofwork-relatedinjuryinsurance.Article7ChineseGovernmentencouragestheresearch,development,popularizationandapplicationofthenewtechnology,processandmaterialbeneficialtothepreventionofoccupationdiseaseandthehealthoflaborers,encouragesthefundamentalresearchonthecausesandrulesofoccupationaldiseases,supportstheadvancementofoccupational-disease-preventiontechnologies,advocateseffectiveutilizationoftechnology,processandmaterialfacilitatingoccupationaldiseaseprevention,andrestrictsorprohibitstheuseoftechnology,processandmaterialseverelyimpairingoccupationalhealth.Article8ChineseGovernmentshallenforcethepolicyforoccupationalhealthsupervision.ThepublichealthauthorityundertheStateCouncilisresponsibleforthesupervisionandadministrationofthenationwidepreventionofoccupationaldiseases.ThecompetentauthoritiesundertheStateCouncilshallberesponsibleforthesupervisionandadministrationofoccupationaldiseasepreventionaccordingtotheirrespectiveadministrativeduties.Thepublichealthauthoritiesunderthecounty-abovepeople’sgovernmentsareresponsibleforthesupervisionandadministrationoftheoccupationaldiseasepreven...
