毕业论文毕业论文题目国有企业劳资纠纷之防范及应对策略系专业班级学生姓名性别指导教师职称2012年5月24日摘要随着我国劳动用工制度改革的深入,如何处理劳资纠纷问题成为全社会所关心的热门话题。作为用人主体之一的国有企业也不可避免地遇到了许多劳资纠纷方面的问题。由于我国实行劳资纠纷处理制度的时间并不长,虽然在劳资纠纷处理制度、程序和方法等方面有很大的改进,但是仍然存在着一些不尽人意之处,从而影响着劳资纠纷有效地处理,不利于劳资纠纷的尽快解决。因此,本文希望能够通过对企业劳资纠纷的特点、类型以及现状的研究,探讨在我国目前劳动法律体系下国有企业预防和处理劳资纠纷的对策,尝试找到一条妥善处理劳资纠纷的理想途径。本文的研究主要包括以下几大部分,首先,指出问题研究的背景和意义,界定论文研究的范围,并且对劳资纠纷研究进行了综述。其次,结合劳资纠纷问题对我国国有企业进行了系统地分析,不仅阐述了我国劳资纠纷的现状及特点,而且分析了我国国有企业劳资纠纷的主要类型。最后,对如何预防和处理劳资纠纷提出了建议,指出国有企业劳资纠纷处理应以预防为主,全面掌握解决劳资纠纷的方法,努力创建和谐的企业劳动关系,尽快实现国有企业建立现代化企业制度的总体目标。关键词:国有企业;劳资纠纷;预防纠纷;处理纠纷AbstractWiththein-depthdevelopmentofChineselaboremploymentsystem'sreformation,howtosolvethelabordisputeshasbecomeahottopicinsocietygradually.Asoneofthemainemployers,thestate-ownedenterprisesalsomeetthisproblem.Chinadoesn'thavemuchexperienceofdisposingthisproblem.Althoughwemadebigprogressinthesystemandprocedureofdealingwithit,therearestillsomeflawsinit.Itaffectsdisposingtheproblemsquickly,efficiently,andholdingbacktheconstructionofharmoniouslaborrelationship.Therefore,Imadesomeresearchesonthelabordisputes'reason,form,actualityandtrendofdevelopmentwithcaseanalysis.Undercurrentlaborlaw,Iwanttofindmywaytodealwiththisproblemandpreventitforstate-ownedenterprises.Thispaperincludesseveralparts.Firstly,itpointsouttheresearches'backgroundandsignificance,definingthescope.Anditreviewsresearchesonthelabordisputes,Includingdefinitionofthelabordisputes,characteristics,types,processingsystem,itslaborrelatedtheoreticalresultsandsoon.Secondly,itsystematicallyanalyzesthestate-ownedenterprises'labordisputesinChinawithcases.ItnotonlyexplainsthestatusandfeaturesofChineselabordisputes,butalsoanalysesthemaintypes,reasonsandtrendsofChinesestate-ownedenterprises.Lastly,itmakesasuggestiononhowtoavoidanddealwithlabordisputes.Itpointsoutthatweshouldtakethepreventionasaprimarymeansinlabordisputesresolutionprocessforstate-ownedenterprises.Theyshouldimprovetheirowninstitution-buildingandreinforcecooperationwiththelocaladministrativedepartments.Theyshouldmastertheskillsdealingwiththeproblemandbuildharmoniouslaborrelationshipandachievethetargetthatthestate-ownedenterprisesestablishthemodernenterprisesystemassoonaspossible.Keywords:State-ownedenterprise;labordisputes;prevention;treatment目录第一章绪论...............................................................11.1问题的提出.............................................................11.2研究的背景意义.........................................................11.3研究思路和方法.........................................................2第二章关于劳资纠纷的内涵.................................................32.1劳资纠纷的界定.........................................................32.2劳资纠纷的特点.........................................................32.3劳资纠纷的类型.................................
