公安执法规范化研究摘要：公安是我国政府机构的重要组成部分，我国相应的法律、法规规定了其担负的职责，享有的职权以及行使取权的程序。其在根据法律、法规在职权范围内进行执法活动，维护公民的合法权益和社会的稳定进行。近年来，公安执法规范化建设引发了社会各界广泛的关注，其是依法治国的贯彻和执行，是法治社会必不可少的一部分。而公安在执法过程中的不规范的行为也时有发生，这是由主客观等多种因素造成的，不规范的执法不仅不利于保护公民的合法权益，还有可能构成违法犯罪，使公安执法在社会的形象受到影响，威信也在大大减退。而公安规范化执法即是法律法规的要求，也是国家相关政策的要求，推进公安执法规范化建设是提高公安执法效率的的重要手段，针对我国目前社会出现的公安执法不规范的现象，笔者公安执法规范化建设研究进行了论述。本文采取论述，发现问题，解决问题的线索展开，共分为四个部分。第一部分公安执法规范化的基础内容，是全文的基础和展开讨论的前提，这部分结合我国相关的法律、法规的规定，比较外国相关理论，论述了公安执法规范化的内涵、特点、必要性，为下文展开铺垫。第二部分，公安执法规范化的具体内容，介绍了其规范执法是优化执法的关键环节，是依法治国的必然选择，是公民权利的内在逻辑，从相关的理论上分析公安执法规范化；第三部分公安执法规范化的现实困境及成因，是本文的重点和难点，结合我国的司法实践分析我国公安执法遇到的困境，以及形成这些困境的成因，从深层次了解公安执法规范化建设遇到的障碍。第四部分公安执法规范化的对策，是本文的重点和难点，就上文提出的问题和难点提出相应的对策，从六个方面来论述了如何推进公安执法规范化的建设。本文“公安执法规范化研究”就是在相关的理论分析的基础上，讨论如何推进公安执法规范化建设发展。关键词：公安执法规范化现实困境对策IAbstract:publicsecurityisanimportantpartofthChinesegovernment,China'srelevantlaws,regulationsandtheresponsibilities,powersandenjoyexerciseweightingprocedures.Inaccordancewitlawsandregulations,withinitsmandatetoconductlawenforcementactivities,safeguardthelegitimaterightsandinterestsofcitizensandsocialstability.Inrecentyears,theconstructionoflawenforcementstandardizationcausedwidespreadconcerninallsectorsofsociety,whichistheimplementationandenforcementoftheruleoflaw,ruleoflawisapartoftheessential.Thepublicsecuritylawenforcementintheprocessofnon-standardbehavioralsooccurs,itiscausedbyvariousfactorssuchastheobjectiveandsubjective,notthestandardlawenforcementisnotconducivetotheprotectionofthelegitimaterightsandinterestsofcitizens,andmayconstituteacrime,thepublicsecuritylawenforcementisaffectedinthesocialimage,prestigeisgreatlydiminished.Thepublicsecuritystandardizationlawistherequirementsoflawsandregulations,butalsorelatedtonationalpolicyrequirements,promotingtheconstructionoflawenforcementstandardizationisanimportantmeanstoimprovetheefficiencyoflawenforcement,thelawenforcementcommunityappearnotstandardphenomenon,theauthoroftheconstructionoflawenforcementstandardizationresearcharediscussed.Thispaperdiscussestheproblemsfound,take,tosolvetheproblemoftheclue,dividesintofourparts.Thefirstpartisbasiccontentofpublicsecuritylawenforcementstandardization,isthefoundationandprerequisitefordiscussion,thispartcombinestheprovisionsofChina'srelevantlaws,regulations,andcomparesforeignrelatedtheory,discussestheconnotationofpublicsecuritylawenforcementstandardization,characteristics,necessity,whichpavesthewayforthefollowingdevelopment.Thesecondpart,theIIspecificcontentofthepublicsecuritylawenforcementstandardization,thestandardlawenforcementistooptimizethekeylinkoflawenforcement,istheinevitablechoi...
