第1页共19页编号：时间：2021年x月x日书山有路勤为径，学海无涯苦作舟页码：第1页共19页OrderofthePresidentofthePeople’sRepublicofChinaTheLawofthePeople’sRepublicofChinaonWorkSafety,adoptedatthe28thMeetingoftheStandingCommitteeoftheNinthNationalPeople’sCongressofthePeople’sRepublicofChinaonJune29,2002,isherebypromulgatedandshallgointoeffectasofNovember1,2002.JiangZeminPresidentofthePeople’sRepublicofChinaJune29,2002LawofthePeople’sRepublicofChinaonWorkSafety(Adoptedatthe28thMeetingoftheStandingCommitteeoftheNinthNationalPeople’sCongressonJune29,2002)ChapterIGeneralprovisionsArticle1ThisLawisenactedforenhancingsupervisionandcontroloverworksafety,preventingaccidentsduetolackofworksafetyandkeepingtheiroccurrenceatalowerlevel,ensuringthesafetyofpeople’slivesandpropertyandpromotingthedevelopmentoftheeconomy.Article2ThisLawisapplicabletoworksafetyinunitsthatareengagedinproductionandbusinessactivities(hereinafterreferredtoasproductionandbusinessunits)withintheterritoryofthePeople’sRepublicofChina.Wherethereareotherprovisionsinrelevantlawsandadministrativeregulationsgoverningfirefighting,roadtrafficsafety,railwaytrafficsafety,waterwaytrafficsafety,thoseprovisionsshallapply.Article3Inensuringworksafety,principleofgivingfirstplacetosafetyandlayingstressonpreventionshallbeupheld.Article4ProductionandbusinessunitsshallabidebythisLawandotherlawsandregulationsconcerningworksafety,redoubletheireffortstoensureworksafetybysettingupandimprovingtheresponsibilitysystemforworksafetyandimprovingtheconditionsforittoguaranteeworksafety.Article5Principalleadingmembersofproductionandbusinessunitsareinfullchargeofworksafetyoftheirownunits.Article6Employeesofproductionandbusinessunitsshallhavetherighttoworksafetyassuranceinaccordancewithlawandtheyshall,atthesametime,performtheirdutyinworksafetyinaccordancewithlaw.Article7Tradeunionsshall,inaccordancewithlaw,makearrangementforemployeestoparticipateinthedemocraticmanagementofandsupervisionoverworksafetyintheirunitsandsafeguardthelegitimaterightsandinterestsoftheemployeesinworksafety.第2页共19页第1页共19页编号：时间：2021年x月x日书山有路勤为径，学海无涯苦作舟页码：第2页共19页Article8TheStateCouncilandthelocalpeople’sgovernmentsatalllevelsshallstrengthentheirleadershipoverworksafetyandsupportandurgeallthedepartmentsconcernedtoperformtheirresponsibilitiesinexercisingsupervisionandcontroloverworksafetyinaccordancewithlaw.Thepeople’sgovernmentsatorabovethecountylevelshall,inatimelymanner,providecoordinationandsolutiontomajorproblemsexistinginsupervisionandoverworksafety.Article9ThedepartmentinchargeofsupervisionandcontroloverworksafetyundertheStateCouncilshall,inaccordancewiththisLaw,exerciseall-roundsupervisionandcontroloverworksafetythroughoutthecountry.Thedepartmentsinchargeofsupervisionandcontroloverworksafetyoflocalpeople’sgovernmentsatorabovethecountylevelshall,inaccordancewiththisLaw,exerciseall-roundsupervisionandcontroloverworksafetyonworksafetywithintheirownadministrativeregions.TherelevantdepartmentsundertheStateCouncilshall,inaccordancewiththeprovisionsofthisLawandrelevantlawsandadministrativeregulations,exerciserelevantsupervisionandcontroloverworksafetywithinthescopeoftheirrespectiveresponsibilities.Thedepartmentsconcernedunderthelocalpeople’sgovernmentsatorabovethecountylevelshall,inaccordancewiththeprovisionsofthisLawandrelevantlaw...
