题目结建人防工程地下停车位的权属问题研究摘要近些年来，我国汽车数量有了很大的增长，从我国执法部门的官方数据中可以看出，在最近12个月内我国总共增长已注册车辆超过三千一百万，现如今我国总共已拥有注册车辆数量三亿两千万以上，其中汽车约占有其中四分之三左右的份额。面对如此高速的车辆增长趋势和规模，国内某些一项城市已经出现了停车位不足的局面。对此，有关部门开始着眼于这一问题，以接班的公共设施管理条例为依据，各级区域都开始配备大型地下停车场，同时其中有很大部分都设置了相应的人防设施，特别是对于其中采用平战结合方式的建筑。随着车辆数量的急速膨胀以及可利用土地面积的收缩，相关部门已经开始给建筑开发单位建立严格的空间配置要求，建造地下车库、车位以缓解居民停车难的问题。本文首先介绍了我国结建人防工程的发展状况；分析了结建人防工程地下停车位国内外立法情况；阐述了结建人防工程地下停车位权属的理论争议及司法实践；揭示了结建人防工程地下停车位的权利归属制度。关键词：结建人防工程；地下停车位；所有权；使用权；收益权；归属ABSTRACTInrecentyears,thenumberofautomobilesinChinahasincreasedgreatly.AccordingtotheofficialdataoflawenforcementagenciesinChina,inthepast12months,Chinahasgrownatotalofmorethan31millionregisteredvehicles.Thenumberofregisteredvehiclesismorethan320million,ofwhichaboutthree-quartersofthecarsaccountforaboutthree-quarters.Facedwithsuchhigh-speedvehiclegrowthtrendsandscale,somecitiesinChinahavealreadyexperiencedashortageofparkingspaces.Inresponse,therelevantdepartmentsbegantofocusonthisissue.Basedontheregulationsforthesuccessionofpublicfacilitiesmanagement,large-scaleundergroundparkinglotswereinstalledinallregions,andalargepartofthemwereequippedwithcorrespondingcivilairdefensefacilities,especiallyforAmongthem,thebuildingadoptsthecombinationofpeacetimeandwarfare.Withtherapidexpansionofthenumberofvehiclesandtheshrinkageoftheavailablelandarea,therelevantdepartmentshavebeguntoestablishstrictspaceallocationrequirementsforbuildingdevelopmentunits,andbuildundergroundgaragesandparkingspacestoalleviatethedifficultyofparkingforresidents.ThispaperfirstintroducesthedevelopmentoftheCivilDefenseprojectinChina,analyzesthedomesticandforeignlegislationofundergroundparkingspacesfortheconstructionofCivilairdefenseprojects,expoundsthetheoreticalcontroversyandjudicialpracticeoftheownershipofundergroundparkingspacesfortheconstructionofCivilairdefenseprojects,andrevealsthenatureandattributionoftherightsoftheundergroundparkingspacesfortheconstruction.Keywords:TobuildaCivilairdefenseproject;anundergroundparkingspace;ownership;righttouse;rightsofreturn;attribution目录诚信声明...................................................................................................................................I摘要......................................................................................................................................IIABSTRACT.........................................................................................................................III第一章绪论....................................................................................................................11.1研究背景......................................................................................................................11.2选题的理论、实际意义..............................................................................................11.2.1选题的理论意义.............................................................
