1摘要城市化的程度和速度是衡量一个国家现代化程度的重要指标。近年来，随着社会的发展和时代的进步，我国城市化的步伐不断加快，城市建设和发展的速度和程度也日新月异。当前，我国城市的建设、改造及扩展的基本前提在城市房屋拆迁规模日益扩大，由此带来侵害城市弱势群体合法权益问题也愈发凸现，由于弱势群体在拆迁过程中，部分人员权利得不到有效保障及相应的法律援助，继而产生情绪激动引发与拆迁单位、项目开发公司和有关政府部门之间的矛盾冲突，使得弱势群体的地位进一步边缘化，更加弱势化，进而影响社会安定稳定、和谐发展。因此，如何妥善处理和解决城市建设中各种力量与弱势群体利益之间的关系，成为我们亟需面对的问题。关键词：城市拆迁；弱势群体；利益保护1AbstractThedegreeandspeedofurbanizationareimportantindicatorsofthedegreeofmodernizationofacountry.Inrecentyears,withthedevelopmentofsocietyandtheprogressofTheTimes,thepaceofurbanizationinChinaisconstantlyaccelerating,andthespeedanddegreeofurbanconstructionanddevelopmentarealsochangingwitheachpassingday.Atpresent,thebasicpremiseofurbanconstruction,transformationandexpansioninurbanhousingdemolition,thusthelegitimaterightsandinterestsofurbanvulnerablegroupsintheprocessofdemolition,somepersonnelrightsarenoteffectivelyguaranteedandcorrespondinglegalaid,andemotionalanddemolitionunits,projectdevelopmentcompanyandrelevantgovernmentdepartments,makethevulnerablegroupsfurthermarginalized,morevulnerable,andaffectthesocial2stability,stabilityandharmoniousdevelopment.Therefore,howtoproperlyhandleandsolvetherelationshipbetweenvariousforcesinurbanconstructionandtheinterestsofvulnerablegroupshasbecomeaproblemthatweurgentlyneedtoface.Atpresent,theproblemsexistingintheprocessofurbanhousingdemolitioninChinaaremainlymanifestedin:thedemolitionsystemisnotperfect,theroleofgovernmentdepartmentsinthedemolition,theineffectivesupervisionofadministrativedepartments,andthecoverageofhousingdemolitionisnotwide.Lawsandregulationsareweak,andthecompensationstandardfordemolitionislow.Theseproblemsdirectlydamagetherightsandinterestsofthevulnerablegroupsinthedemolition,leadingtotheincreasednumberofpetitions,andevenself-immolation,jumpingandotherbuildings,aggravatesocialcontradictions,disturbsocial3order,anddestroysocialstability.Tosolvethechaosofurbandemolition,Chinaisfarfromenoughtorelysolelyonthegovernment'sadministrativeordersalone,whichisnotenoughtocompletelysolvetheproblem.Therightsofthevulnerablegroupsshouldbefundamentallyguaranteedanddefended.Firstofall,thefunctionaldepartmentsoftheChinesegovernmentshouldclarifythelegislativeconcept,reviseandimprovethecurrentlawsandregulations,sothatthejudicialprocedurescaninterveneintheurbandemolitionchaosinatimelyandeffectivemanner.Sincethereformandopeningup,theprotectionofvulnerablegroupshasattractedwideattention.Fromprotectingtheinterestsofvulnerablegroups,thispaperstudiesthelackofurbanhousingdemolitionlegislationinChina,andputsforwardcorrespondingsuggestions.Thispaperpreliminarilydiscussesthesocialvulnerablegroupsandtheirrightsprotectionfromthe4perspectiveofexistinglawsandregulations.Keywords:urbandemolition;vulnerablegroups;interestprotection12目录摘要.............................................................................................................................1目录.............................................................................................................................2第一章绪论......................................
