摘要自动漫卡通诞生以来,其相关产业就得到了迅速的发展,尤其是在美日等发达国家,动漫卡通带来了非常诱人的经济利益,展现出了其拥有的非常大的市场前景。但是,侵犯动漫形象合法权益的情况时常发生,为商家带来了经济上的损失。比较经典的侵权案件就要数美国迪士尼公司的十几种动漫形象被侵权案和日本的“大力水手”侵权案。与此同时,由于我国蕴藏了非常丰富的文化资源,再加上政府的大力支持,改革开放以后,我国的动漫形象产业以前所未有的势头发展壮大起来。众所周知,闻名的动漫形象就像“石油”一样,非常稀有,蕴含着无穷的经济价值,所以,在利益的驱动下,我国市场上动漫卡通形象侵权的现象也愈演愈烈。由于《知识产权法》中并没有单独规定动漫卡通形象的侵权保护问题,再加上市场上盗版等侵权形式花样百出,目前的法律已经无法再适应新出现的侵权现象。通过调查研究的数据显示,我国社会群众对知识产权侵权问题认识不够全面,缺乏系统的理解,不懂得事前通过注册商标或者申请外观设计等方法来预防侵权行为。所以本文立足于目前市场上出现的动漫卡通形象知识产权侵权问题,通过对目前美国、日本、德国等发达国家与我国对动漫形象在著作权、商标权、外观设计、商品化权、反不正当竞争法等知识产权保护方面的现状进行分析与研究,经过文献检索法与对比分析法,对比分析出我国在立法与实践中对动漫形象保护研究的缺陷,通过借鉴国外立法与实践的经验与教训,然后提出目前我国动漫卡通形象侵权问题的解决方法。关键词:动漫卡通形象;知识产权侵权;著作权;商品化权;商标权OntheintellectualpropertyprotectionofcartoonimageAbstractSincethebirthofthecartoon,relatedindustryhasbeenrapiddevelopment,especiallyinthedevelopedcountriessuchasJapan,cartoonhasbroughtveryattractiveeconomicbenefits,showingitsgreatmarketprospects.However,violatedthelegitimaterightsandinterestsofthecartoonimageisoftenthecase,bringeconomiclossesforbusinesses.ComparedtotheclassicaltortcasestotenkindsofcartoonimagenumberDisney'sbeenvigorouslyseamanandJapan's"infringement"infringementcase.Atthesametime,becauseChinahasaveryrichculturalresources,coupledwiththestrongsupportofthegovernment,afterthereformandopeningup,China'sanimationindustrytoimageThehithertounknownmomentumgrowingup.Aseveryoneknows,thefamouscartoonimageas"oil",veryrare,containsendlesseconomicvalue,therefore,drivenbyinterests,China'smarketcartoonimageinfringementisintensifying.Duetotheprotectionofintellectualpropertyrightsinfringementproblem,andnoseparatemethodtheprovisionsofthecartoonimage,plusmarketpiracyinfringementtricks,thecurrentlawhasnotbeenabletoadapttothenewtortphenomenonappeared.ThroughtheinvestigationandstudydatashowthatChina'ssocialmassesontheinfringementofintellectualpropertyrightslackofcomprehensiveunderstanding,lackofunderstandingofthesystem,donotknow.Beforetheregisteredtrademarkorapplicationfordesignmethodstopreventinfringement.Sothispaperisbasedontheproblemofintellectualpropertyinfringementcartoonimageappearsonthemarketatpresent,accordingtotheUnitedStates,Japan,Germanyandotherdevelopedcountriesandourcountrytothecartoonimageinthecopyright,trademark,design,merchandisingright,analysiswiththeresearchoncurrentsituationofantiunfaircompetitionlawandintellectualpropertyprotection,throughliteraturesearchandcomparativeanalysis,thecomparativeanalysisofourcountryinthelegislationandpracticeofprotectionofcartoonimagedefects,throughtheexperiencesandlessonsofforeignlegislationandpractice,andthenputforwardChina'scartoonshapeLikethesolutiontotheinfringementproblem.Keywords:cartoonimage;intellectualpropertyinfringement;copyright;merchandisingright;trademar...
