PUBLICLIABILITYINSRUANCECLAUSESI.SOPEOFCOVER1.TheinsurershallinthemannerhereinafterprovidedindemnifytheInsuredagainstsuchsumswhichtheInsuredshallbecomelegallyliabletopayasdamagesinrespectofdeathoforbodilyinjurytothirdparties,orlossofordamagetopropertybelongingtothirdparties,inconsequenceofanaccidentoccurringindirectconnectionwiththeperformanceoftheworkandhappeningonorinthevicinityofthepremisesstatedintheScheduleduringtheperiodofinsurance;2.Inrespectofanyclaimcoveredunderthispolicy,theinsurershallinadditionindemnifytheInsuredagainsttherelevantlegalcostspayablebytheInsuredandotherexpensesincurredwiththepriorwrittenconsentoftheinsurer;3.TheindemnificationmadebytheinsurerforanyoneaccidentshallbesubjecttotheamountstobepayablebytheInsuredwhicharedecidedinaccordancewiththelawbythecourtorthegovernmentaldepartmentconcerned.ProvidedalwaysthattheliabilityoftheinsurershallinnocaseexceedthelimitsofindemnityforanyoneaccidentstatedintheSchedule,andduringthewholeperiodofinsurance,themaximumliabilityoftheinsurershallinnocaseexceedtheaggregatelimitofindemnityasstatedintheSchedule.DEFINITION:TheWord“ACCIDENT”shall,forthepurposeofthisPolicymeananyunforseenable,uncontrollablebytheInsuredandsuddenoccurrenceeventwhichleadstomaterialdamageorbodilyinjury.II.EXCLUSIONSTheinsurershallnotbeliablefor:1.liabilityassumedinaccordancewithanyagreementbetweentheInsuredandotherparties,unlesssuchliabilitywouldhavebeenattachedtotheInsurednotwithstandingsuchagreement.2.liabilityinrespectofinjurytoanypersonwhoatthetimeofsustainingsuchinjuryisengagedintheserviceoftheInsured.3.liabilityinrespectofdamagetofollowingproperty:3.1belongingtoorinthechargeorunderthecontroloftheInsuredorhisrepresentativeoremployee;3.2beingthatpartofanygoodsorlandorbuildingorstructureonwhichtheInsuredorhisrepresentativeoranyemployeeisorhasbeenusingoroccupying.4.liabilityinrespectofinjuryordamagecausedbyorinconnectionwithorarisingfrom:4.1theownershiporpossessionorusebyoronbehalfoftheInsuredofanyanimal,cycle,vehicle,locomotive,vesselofanykind,aircraft,lift,elevator,escalator,crane,hoistorotherliftingmachinerynotspecifiedintheSchedule.4.2fire,earthquake,explosionfloodor,fumes;4.3pollutionofanykindordescriptionwhatsoeversuchasatmosphere,landandwaterpollutions;4.4defectivesanitaryinstallationorpoisoningofanykindofforeignordeleteriousmatterinfoodordrink.4.5remedialortreatmentadvicegivenoragreedbytheInsured.5.liabilityinrespectoforarisingfromdamagetoanylandorpropertyorstructurecausedbyvibrationorremovalorweakeningofsupport.6.liabilityforanyconsequencearisingdirectlyorindirectlyfromwar,warlikeoperation,hostilities,armedconflicts,terrorism,conspiracyinsurrection,coupd’etat;7.liabilityforanyconsequencearisingdirectlyorindirectlyfromstrike,riot,civilcommotionormaliciousacts;8.intentionalactorgrossnegligenceoftheInsuredandhisrepresentative.9.liabilityarisingdirectlyorindirectlyfromnuclearfission,nuclearfusion,nuclearweapon,nuclearmaterial,nuclearradiationandradioactivecontamination;10.fines,penalties,punitiveorexemplaryindemnities;11.thedeductiblesstatedintheScheduletoorstipulatedinthePolicybebornebytheInsured.III.TREATMENTOFCLAIM1.Intheeventofanyclaimrecoverableunderthispolicy:1.1Iftheinsuredmakeorgiveadmission,rejection,offer,promise,paymentorindemnitywithoutthewrittenconsentoftheinsurer,theinsurershallnotbeliabletoanyclaims.Andtheinsurershall...
