论我国行政复议制度的缺失与完善分析

论我国行政复议制度的缺失与完善2008 级行政法二班张莹20080640231 内容摘要 ：行政复议制度是行政救济制度的重要组成部分，这一制度对于保护行政相对人的合法权益， 监督行政主体正确行使行政职权，维护社会公正与安定有着重要意义。 但由于其程序存在的一些缺陷致使行政复议制度没有发挥应有的作用，针对该缺陷， 并立足我国复议工作的实践提出了完善我国行政复议程序的几点具体思路。关键词 ：行政复议管辖体制复议范围复议程序Abstract: the administrative reconsideration system is an important part of administrative relief system, the system for the protection of the administrative relative person's legitimate rights and interests, supervising the administrative organs to exercise the administrative powers correctly, maintaining social justice and stability has important significance. But because of its procedure existence some flaws in the administrative reconsideration system did not play its due role, aiming at the defects, and based on our review of the practice of the perfection of the administrative reconsideration procedure a few specific train of thought. Key words: administrative reconsideration jurisdiction reconsideration reconsideration procedure 行政复议，是指行政相对人认为行政主体的具体行政行为侵犯其合法权益，依法向行政复议机关提出复查该具体行政行为的申请，行政复议机关依照法定程序对被申请的具体行政行为进行合法性、适当性审查， 并作出行政复议决定的一种法律制度。我国在立法和制度实践上， 行政复议被认为是一种层级监督的方式，是上级行政机关行使对下级行政机关监督权的体现，强化了行政复议的监督功能，弱化了它的救济作用。 随着实践的展开， 这种制度设计的弊端越来越凸显出来，行政复议机构应有的独立性缺乏，使得行政复议所追求的层级监督功能流于形式；行政复议程序过于简单， 缺乏可操作性， 使得行政复议所不可或缺的公正性得不到程序上的体现和保障。一、行政复议程序制度的现实问题（一）行政复议体制设置不合理行政复议机构的独立性是保证行政复议结果公正性的必然要求。国外类似我国行政复议机构的， 如美国...
