成 人 高 等 教 育毕 业 论 文（设计）论文题目 学 院： 专 业： 层 次： 年级班级： 身份证号： 学生姓名： 指导老师： 论我国夫妻财产制度的缺陷及完善摘要夫妻财产关系是夫妻关系必不可少的重要内容，夫妻财产制是调整夫妻财产的法律制度，在婚姻家庭立法中具有十分重要的地位。2001 年修正后的《婚姻法》首次确立了夫妻个人特有财产制，构建了婚后所得共同制、夫妻约定财产制、夫妻个人特有财产制三制并存的夫妻财产的法律制度，必将对新形势下的夫妻财产关系、婚姻家庭关系产生深远影响。但新的夫妻财产制随着社会主义市场经济体制在我国确立，所有权形式日趋复杂，社会和家庭的财产关系己发生了巨大的变化，人们对家庭和财产的需求也趋向多元化、复杂化。然而 2001 年修改后的婚姻法所确立的夫妻财产制仍显露出过于原则、简单等缺陷。这就给司法实践造成了难以操作等问题，长此以往，有损于家庭的稳定与和睦，并影响社会的安定。因此，有必要在理论上总结实践经验，借鉴国外立法，反思现行制度，提出进一步完善我国夫妻财产制的全面、具体的设想，使夫妻财产更科学、体系更完整、操作性更强，更好地调整夫妻财产关系，完善我国的夫妻财产制度。关键词：夫妻财产制 现状 原则 缺陷 完善ABSTRACTMatrimonial property relations is the essential content of the relationship between husband and wife, matrimonial property system is the adjustment of the legal system of the marital property, has a very important position in the marriage and family legislation.
