I劳动合同经济补偿制度研究内 容 摘 要用人单位与劳动者签订劳动合同以后,就代表了双方确定了劳动关系,劳动者不论是经济实力还是社会地位,都不能和用人单位一方相比较,他们通常处于比较弱势的地位,而用人单位在用工方面是有绝对话语权的,因此,劳动合同经济补偿制度的存在及立法目的,就是为了保护处于不平等地位的劳动者的合法权益,这为构建和实现稳定和谐的劳动关系以及促进经济社会的发展奠定了基础。本文根据经济补偿制度的基本理论,包括经济补偿金的概念、存在的目的、本质和特征,以及我国劳动合同经济补偿制度现有的的立法规定,从而研究该制度本身存在的一些问题,并总结提出解决问题的方法。关键词:经济补偿金;劳动合同解除;弱势地位;法律规定;劳动合同A Study on The Economic Compensation System of The Employment ContractIIAbstractOnce the employer and the worker have established the employment contract, both parties determine that the labor relations, whether economic strength or social status, workers can not be compared with the employer side, they are usually in a weaker position, employers have an absolute say in the employment of workers.
