This paper from two aspects of social ethics and legislation of a third party against the right spouse, the reason argument against the spouse of a third party the right to establish the legal responsibility of the spouse of the necessity and the right against a third party tort liability should apply to the cause, manner.Key words: Consortium; a third party; tort liability近几年来，从官场到普通人的生活，中国社会的“第三者”现象愈演愈烈。据调查，在近年来不断上升的离婚案件中，因“第三者插足”的就占 70%。因“第三者”导致的离婚率比 10 年前增加了 30 倍。2007 年民间焦点“张美然殷琪事件（史上最牛的小三，又称 3377 门）”，2008 年初的“胡紫微张斌事件”，姜岩自杀事件等更是将第三者插足婚姻关系的严重后果摆在了人们的面前。能否由法律来惩罚“第三者”和婚姻关系中的过错方一直是人们关心的话题。2010 年 11 月 6 日，中国法学会婚姻法学研究会 2010 年年会再次将这个问题提到公众的面前，显然，怎样保护婚姻家庭，保护配偶权在当代中国已是一个引起广泛关注，值得探讨的严肃问题。本文试图从分析第三者侵害配偶权的原因入手，论证确立第三者侵害配偶权的法律责任之必要性及第三者侵害配偶权应适用侵权责任的原因、方式。一 第三者侵害配偶权的原因探讨（一）社会原因正如社会学...
