住房抵押贷款保证保险合同研究摘 要住房抵押贷款制度于 20 世纪 90 年代引入我国,它带来了房地产市场的飞速发展,但也暗藏着巨大的风险。“无风险,无保险”,与之相应的住房抵押贷款保险应运而生。目前我国只存在住房抵押贷款财产保险、住房抵押贷款人身保险和集住房抵押贷款财产保险和保证保险于一体的住房抵押贷款综合保险。本文仅就住房抵押贷款保证保险进行研究。保证保险起源于信用发达的美国,随后在西欧不少国家和日本陆续开办。我国保险公司保证保险业务起步较晚,个人消费信用制度尚未健全,相关的立法又相对滞后。我国的履约保证保险合同无论是在理论研究方面,还是在保险实务和司法实践方面,均存在不足之处。在理论研究方面,研究者关注的焦点多集中在履约保证保险合同的含义和性质方面。在保险实务界,履约保证保险业务不仅发展的较为缓慢,而且存在管理松弛等弊端。在立法和司法实践方面,由于我国现行保险法欠缺对履约保证保险合同的规定,不同的法院可能会适用不同的法律处理同样的履约保证保险合同纠纷——针对上述现象,本文从住房履约保险这一具体险种出发,对合同的属性做出了定性,明确了合同的主从地位,并对合同的主体,客体和内容进行了详细的阐述,并对理论和事务界常见问题进行分析,希望对住房抵押贷款保证保险的发展有所裨益。关键词:住房抵押贷款,保证保险,保险利益ABSTRACTMortgage system was introduced to China in the 1990s, which has brought to the rapid development of the real estate market, but also hidden great risk.
