AbstractInquisition by torture is a criminal acts that violating the rights of people, and damaging the dignity of law. Chinese law has defined that inquisition by torture is forbidden, In the judicial practice, inquisition by torture still occurs because of the impact of traditional value and the deficiency. Forbidding inquisition by torture is the requirement of not only the law itself, but also of the need of constructing a legislative socialist country. This article is starts from the importance of forbidding inquisition by torture, and the situation and damage of it. Under the influence of traditional views by time, unreasonable power division, inadequate monitoring system and so on, the author stresses that China must strictly prohibit inquisition by torture, and puts forward a number of measures to prevent it.Key words: Inquisition by torture ； Cases of true ； Combination of detection and judgment；The right of silence严禁刑讯逼供问题的探究刑讯逼供，是指在刑事诉讼过程中，司法工作人员对犯罪嫌疑人、被告人采纳肉刑、变相肉刑或精神折磨的方法以逼取口供的行为。刑讯逼供具有非常大危害性，它模糊了有罪和无罪的外部差异，增加了侦查破案的难度。而刑讯逼供最大的危害在于容易造成冤假错案，通过刑讯逼供使拒不认罪的罪犯如实招供的虽然不少，但更多地是致使无辜者因肉刑摧残而乱攀乱供，含冤受罚。同时，刑讯逼供还容易导致被告人在审判中翻供，使得检察官和法官陷入进退两难的尴尬境地。另外刑讯逼供违反程序公正且会导致司法人员滥用手中的权力和人民给予他们的执法权，使司法机关的形象和权威严重受损。因此，对刑讯逼供进行深化的探讨显得十分重要，无论是在法学讨论还是在司法实践中都具有极其重要的意义。一、刑讯逼供的现状（一）我国关于严禁刑讯逼供的立法规定我国法律对刑讯逼供现象是严禁的，《刑事诉讼法》第 43 条规定:“审判人员、检察人员、侦查人员必须依照法定程序，收集能够证实犯罪嫌疑人、被告人有罪或者无罪，犯罪情节轻重的各种证据。严禁刑讯逼供和以威胁引诱、期骗...
