中文摘要社区矫正是一种与监禁矫正相对的行刑方式，重在矫正犯罪心理和行为恶习，并促进矫正对象顺利回归社会的非监禁刑罚执行活动。本文首先论述完善我国社区矫正制度的重要性。其次论述现阶段我国社区矫正制度存在的问题。主要表现在我国社区矫正的立法相对滞后，社会公众对社区矫正难以认同，社区矫正试点地区分布不均和队伍建设有待完善，矫正执行有待完善，社区矫正所需资金没有制度保障等方面。再次论述国外的社区矫正制度的立法经验及其对我国的启示。最后论述完善我国社区矫正制度的对策。一是立法上完善我国社区矫正制度；二是转变重刑主义思想，营造社区矫正的社会氛围；三是兼顾矫正区域均衡进展，强化矫正队伍建设；四是改进矫正方式，丰富教育手段；五是落实后勤保障，确立财政保障体制。关键字：社区矫正；刑罚执行；刑罚改革AbstractCommunity correction is a correction mode opposite to imprisonment correction and a kind of non-custodial penalty enforcement activity to promote corrective object returning back to community, which is focus on criminal mind and vice correction. In this paper, firstly, the importance of perfection to community correction system would be discussed. Secondly, the problem of community correction system in China at present would be analyzed. This existing problem mainly result from the lag of legislation, the disapproval of the public and the unequal distribution, so do the need to improve the team construction, the methods of implementation, income-maintenance programs and etc. The next part is about the reveal to China from the foreign community correction experience. At last, the strategy about perfection of community correction system in China would be discussed. First, improving the domestic community correction system on a basis of law.
