本科毕业设计-浅析电子提单的法律问题

AbstractTraditional bill of lading system has been no longer met the requirements of modern shipping technology. Electronic bill of lading is built on the basis of the technology development of Computer and network. It could solve most problems of traditional bills of lading. But electronic bill of lading has been produced for only a few decades, and the relevant legislation is not perfect. To let the Electronic bills of lading replace the traditional ones, there are still many legal obstacles. Comparing relevant regulations on electronic bill of lading, this paper mainly discusses three legal issues: the liquidity, the function as a receipt of goods, and the weight of evidence of electronic bills of lading. Comparing nowadays solutions, it explores the way out of legal obstacles in the application of electronic bill of lading. Then considering the situation in China, it gives some legislative suggestion on electronic bill of lading.Key words：Electronic bill of lading； Liquidity； Weight of evidence浅析电子提单的法律问题电子提单产生于电子商务进展如火如荼的大背景下，它是计算机和网络技术飞速进展的产物，以电子数据交换技术（EDI）为基础。电子提单有着传统提单无可比拟的优势——价格低廉、流转快速、安全方便，它的产生是对传统提单制度的一次革命。但由于缺少权威理论和完善的立法，电子提单在受到日益重视并越来越被广泛应用的同时，却面临着一系列的法律问题。提单电子化将是提单进展的趋势，而解决其法律上的障碍将是各国立法的重点所在。本文对实践中电子提单的流通性，证据力和实现货物收据功能方面遇到的法律问题进行分析，并探讨其解决途径。鉴于目前我国在电子提单方面的讨论还不成熟，随着实践的进展不断暴露出我国海商法在这一新领域的理论讨论和立法的不足，为了顺应国际海运事业的进展趋势和国际理论界对电子提单问题的普遍关注，我们有必要对电子提单的这些法律问题作出进一步的讨论。一、电子提单的产生电子数据交换，是指根据协议，在两个或两个以上的贸易伙伴...
