ABSTRACTPublic interest is the only lawful purpose for land expropriation.Government can use the power of land expropriation only for public interest.But it is accepted by constitution law and other legislations of our country that the land should be requisitioned for public interest,there seems to be a problem that some of these regulations are unclear or in conflict.The issue of abuse of adminstrative expropriation power is rather terrible that enclosure movements by governments waste lots agricultural lands,which result in many social problems such as dealing of power and pocket and power rend-seeking activities. This paper is thereby focused on this specific topic where deep analyzed the public interest in land expropriation .And suspension of the public interest in land expropriation, through drawing on the experience exist in other countries on China's building a system to suspend the the public interest in land expropriation of a number of recommendations put forward specific.KEY WORDS ： land expropriation ； public interests ； definition of public interests；system be completed浅论我国土地征收中公共利益的界定我国的土地征收是指国家为了公共利益的需要，行使土地征收权，强制取得农村集体土地所有权，集体土地所有权因国家的征收而消灭。公共利益是土地征收的唯一合法目的，但由于我国法律对土地征收中公共利益的范围缺乏明确界定和对程序缺乏必要的法律规范，导致政府大规模的圈地，大量的农地被浪费，并由此引发各种社会冲突，影响社会稳定，造成权钱交易、权利寻租现象猖獗。本文拟通过对我国土地征收中公共利益的界定所产生的法律问题进行分析，对完善我国土地征收中公共利益中的法律界定和法律规范提出建议，使有关土地征收的法律法规真正发挥公共利益的制度价值。一、我国土地征收中公共利益界定的意义近年来，中国城市化的步伐正在加快，出现了大量的征地现象。为了杜绝土地征收中的公共利益被随意扩大，甚至成为违法行政征收的挡箭牌，我们迫切需要从...
