本科毕业设计-试论我国短期自由刑制度的完善

中文摘要在我国刑罚体系中，3 年以下有期徒刑属于短期自由刑，其能够满足惩处犯罪，保护人民的需要，并有利于实现预防犯罪、防卫社会的目的。从我国短期自由刑的适用情况来看，存在着一些问题：如短期自由刑适用范围过于广泛、短期自由刑的执行方式单一、短期自由刑的执行条件差等。本文通过对其他国家短期自由刑的比较讨论与借鉴，提出完善我国短期自由刑的建议。完善短期自由刑，可减少诉讼环节，降低诉讼成本，从而集中人力、物力查办严重刑事犯罪，突出打击重点。关键词：短期自由刑；预防犯罪；周末监禁；社区矫正AbstractPenalty system in China, 3 years imprisonment sentence is short-term free, which ability to meet the punishment of crime, protection of people's needs, conducive to the purpose implementation of crime prevention and defense community. From the point of view, the application of short-term free sentence in china, there are some problems: scope too broad,single means of implementation, poor implementation of detention. In this paper,comparative study and learn through other countries' short-term free sentence, recommendations put forward improvement of short-term free sentence. Improving the short-term free sentence, to reduce the litigation links and cut down the litigation cost to focus on human and material, which investigated the serious criminal and highlighted the blow key.
