本科毕业设计-试论我国网络隐私权的立法保护

AbstractIn the information age, the development of the Internet technology brings us efficiency and at the same time it poses an unprecedented threat to the privacy and safety of personal information material. This paper analyzes discusses the United States’ protected mode which mainly due to industry self-regulation, and policy-supplemented by the legislation, and the European Union’s protection system which regulate the Internet privacy mainly due to legislation, and analyze the characteristics of the two models and its shortcomings and analyze the status of our country’s legal protection system of network right of privacy ， puts forward some suggestions on the perfection about the system．Key words: Personality right；Internet；Right of privacy；Network right of privacy试论我国网络隐私权的立法保护计算机网络飞速进展并广泛应用于各个行业。一方面网络的全球性、开放性、快捷性、交互性、虚拟性、实时性极大地推动了政治、经济、军事、教育、金融、交通、通讯等的进展，另一方面，人们的私生活也受到前所未有的威胁，网络隐私越来越受到人们的重视。人们在感受信息获得便捷的同时，网络隐私侵权现象也日益突出，防不胜防，网络隐私权问题已是一个重要的讨论课题。目前学界对于网络隐私权的概念尚没有统一的表述。主流的观点普遍主张把网络隐私权作为一种独立的人格权，以王明雯为代表的学者认为网络隐私权是指自然人在网络世界中就其私人信息、私人空间和私人活动享有控制支配并排除他人非法干涉和侵扰的一种人格权。①网络隐私权的提出主要用以区别现实生活的隐私权，作为传统隐私权的一种补充和扩展形式。笔者同意以上观点并且认为，网络隐私权与传统的隐私权在本质上是一样的，但隐私权由于互联网的进展而使得其主体、客体和行使范围得以扩张，网络隐私权具有经济性、保护的范围更广泛、侵权更为容易和隐蔽等新特性。以下将针对网络隐私权展开论述。一、当前网络隐私权立法保护的必要性网络是把双刃剑，在给我们带来方便快捷的同时也来带了很多隐忧，互联网具有跨地域性，而且信息容量和流量极大，网络信息的流传和买卖很便捷、迅速和高效，加上...
