本科毕业设计-试论我国违宪审查制度的完善

AbstractThe foundation and improvement our country’s judicial review has been discussed for many years in the theory Circle, and the debate focused on how to choose the system. In my opinion, improve our system of constitutional review is the way to protect the legal rights of citizens, strengthening the authority of the Constitution, to ensure an integral part of implementation of the constitution. In this paper, the Improvement of the constitutional need for censorship as the starting point of the constitutional review system. And we will analyses the major problems, and learn from successful experiences of foreign-related, put forward effective suggestions.Key words: Constitution ； Constitutional Review ； Constitutional Committee试 论 我 国 违 宪 审 查 制 度 的 完 善宪 法 的 有 效 实 施 是 实 现 依 法 治 国 的 前 提 ， 而其 中 关 键 的 问 题 在 于 能 否 设 立 一 种 权 威 的 、 可 操作 的 违 宪 审 查 制 度 。 但 我 们 国 家 目 前 违 宪 情 况 十分 严 重 ， 公 民 的 合 法 权 利 得 不 到 应 有 的 保 护 。 所以 ， 讨 论 如 何 完 善 违 宪 审 查 制 度 对 于 我 国 法 治 建设 有 十 分 重 大 的 理 论 价 值 和 实 践 意 义 。一 、 完 善 我 国 违 宪 审 查 制 度 的 必 要 性违 宪 是 一 切 违 法 案 件 中 性 质 最 为 严 重 的 ， 因其 破 坏 的 是 国 家 最 根 本 的 社 会 关 系 。 违 宪 问 题 的长 期 存 在 并 得 不 到 处 理 ， 给 我 国 法 治 建 设 带 来 许多 不 确 定 性 。 完 善 我 国 违 宪 审 查 的 必 要 性 体 现 在以 下 三 个 方 面 ：（ 一 ） 有 利 于 强 化 宪 法 的 权 威 性宪 法 是 我 国 的 根 本 大 法 ， 具 有 最 高 的 法 律 地位 ， 是 社 会 主 义 法 律 体 系 的 基 础 。 公 民 的 权 利 只有 得 ...
