AbstractAs one of the basic rights protected by the Constitution, liberty of the press plays a significant role in the contemporary society governed by the rule of law. Meanwhile, the Constitution provides that the general right of personality and specific right of personality of citizens are protected as basic rights. The improper practice of the liberty of press leads to the press infringement of rights, which inevitably infringes upon the basic human rights of citizens. Yet, the mere emphasis on the private rights of citizens will hinder the proper exercise of the freedom of the press. It has been a common issue discussed by the people studying laws and people from the press and media on how to reach a balance between the freedom of the press and the private rights of citizens, that is, to fully exercise the liberty of the press without any infringement of the citizens' right of personality. This article sets forth the manifestation and social significance of its violation. It explores the ways to balance the freedom and the infringement of the press by examining the causes of conflicts between them.Key words: Liberty of the press；The press infringement of rights；Press law试论新闻自由与新闻侵权随着信息技术的进展，新闻传播事业在社会上的作用也被越来越受到人们的广泛关注。新闻自由是现代民主社会确立的公民的基本自由之一，是指新闻机构工作人员为实现其为社会服务的功能，依法采访、写作、发表、出版新闻作品，不受非法控制、约束的权利，它对保障公民对政府的监督，保证政府听取民意、凝聚民智，保障公民的知情权，促进民主社会的进展具有极其重要的作用。新闻侵权是指报纸、杂志等故意或过失的刊登诽谤他人的新闻，造成受害人的名誉权等人格权损害的行为。近年来，随着新闻事业的不断进展，新闻侵权现象时有发生，新闻自由与新闻侵权之间的矛盾与冲突日益突显并严重影响着国家与社会的进展，因此寻求新闻自由与新闻...
