外国人在中国就业管理规定(英文版)RULESFORTHEADMINISTRATIONOFEMPLOYMENTOFFOREIGNERSINCHINA(PromulgatedjointlybytheMinistryofLabour,MinistryofpublicSecurity，MinistryofForeignAffairsandtheMinistryofForeignTradeandEconomicCooperationofthePeople'sRepublicofChinaon22January1996）ChapterlGeneralProvisionsArticle1TheseRulesareformulatedinaccordancewiththeprovisionsoftherelevantlawsanddecreesforthepurposeofstrengtheningtheadmiministrationofemploymentofforeignersinChinaArticle2Theterm"foreigners"intheseRulesreferstothepersons，whoundertheNationalityLawont1ePeople'sRepublicofChina,donothaveChinesenationality．Theterm"employmentofforeignersinChina"intheseRulesreferstoactsofforeignerswithoutpermanentresidencestatustoengageinremunerativeworkwithinChineseterritoryinaccordancewithitlaws．Article3TheseRulesshallapplytoemployedforeignerswithinChineseterritoryandtheiremployers．TheseRulesshallnotapplyt。foreignerswhoenjoydiplomaticprivilegesandimmunitiesemployedbyforeignembassiesorconsulates，ortheofficesoftheUnitedNationsandotherinternationalorganizationsinChina．Article4Thelabouradministrativeauthoritiesofthepeople'sgovemmer1toftheprovinces，autonomousregionsandmunicipalitiesdirectlyundertheCentralGovernmentandthoseattheprefectureandcitylevelwiththeirauthorizationareresponsiblefortheadministrationofemploymentofforeignersChina.ChapterIIEmploymentLicenseArticle5TheemployershallapplyfortheemploymentpermissionifitintendstoemployforeignersandmaydosoafterobtainingapprovalandThePeople'sRepublicofChinaEmploymentLicenseforForeigners（hereinafterreferredtoasthe"EmploymentLicense").Article6Theposttobefilledbytheforeignerrecruitedbytheemployershallbethepostofspecialneed，apostthatcannotbefilledbyanydomesticcandidatesforthetimebeingbutviolatesnogovernmentregulationsNoemployershallemployforeignerstoengageincommercializedentertainingperformance，exceptforthepersonsqualifiedunderArticle9（3）oftheseRules．Article7AnyforeignersseekingemploymentinChinashallmeetthefollowingconditions：（1）18yearsofageorolderandingoodhealth（2）withprofessionalskillsandjobexperiencerequiredfortheworkofintendedemployment；（3）withnocriminalrecord；（4）aclearly-definedemployer;（5）withvalidpassportotherinternationaltraveldocumentinlieuofthepassport（hereinafterreferredtoasthe"TravelDocument").Article8ForeignersseekingemploymentinChinashallholdtheEmploymentVisasforthewentry（Incaseofagreementformutualexemptionofvisas，theagreementshallprevail.),andmaywokwithinChineseterritoryonlyaftertheyobtaintheEmploymentPermitforForeigner（hereinafterreferredtoasthe"EmploymentPermit"）andtheforeignerresidencecertificateForeignerswhohavenotbeenissuedresidencecertificate(i.e.holdersofF，L，CorG-typesvisas），andthosewhoareunderstudyorinterimprogramsinChinaandthefamiliesofholdersofEmploymentVisasshallnotworkinChina．Inspecialcases，employmentmaybeallowedwhentheforeignerchangeshisstatusatthepublicsecurityorganswiththeEmploymentLicensesecuredbyhisemployerinaccordancewiththeclearanceprocedures1undertheseRulesforeignerschangeshisstatusatthepublicsecurityorganswiththeEmploymentLicenseandreceiveshisEmploymentpermitandresidencecertificate．TheemploymentinChinaofthespousesofthePersonnelofforeignernbassies,consulates，representativeofficesoftheUnitedNationsSystemandotherinternationalorganizationinChinashallfollowtheProvisionsofMinistryofForeignAff...
