外国人在中国就业管理规定(英文版)RULESFORTHEADMINISTRATIONOFEMPLOYMENTOFFOREIGNERSINCHINA(PromulgatedjointlybytheMinistryofLabour,MinistryofpublicSecurity,MinistryofForeignAffairsandtheMinistryofForeignTradeandEconomicCooperationofthePeople'sRepublicofChinaon22January1996)ChapterlGeneralProvisionsArticle1TheseRulesareformulatedinaccordancewiththeprovisionsoftherelevantlawsanddecreesforthepurposeofstrengtheningtheadmiministrationofemploymentofforeignersinChinaArticle2Theterm"foreigners"intheseRulesreferstothepersons,whoundertheNationalityLawont1ePeople'sRepublicofChina,donothaveChinesenationality.Theterm"employmentofforeignersinChina"intheseRulesreferstoactsofforeignerswithoutpermanentresidencestatustoengageinremunerativeworkwithinChineseterritoryinaccordancewithitlaws.Article3TheseRulesshallapplytoemployedforeignerswithinChineseterritoryandtheiremployers.TheseRulesshallnotapplyt。foreignerswhoenjoydiplomaticprivilegesandimmunitiesemployedbyforeignembassiesorconsulates,ortheofficesoftheUnitedNationsandotherinternationalorganizationsinChina.Article4Thelabouradministrativeauthoritiesofthepeople'sgovemmer1toftheprovinces,autonomousregionsandmunicipalitiesdirectlyundertheCentralGovernmentandthoseattheprefectureandcitylevelwiththeirauthorizationareresponsiblefortheadministrationofemploymentofforeignersChina.ChapterIIEmploymentLicenseArticle5TheemployershallapplyfortheemploymentpermissionifitintendstoemployforeignersandmaydosoafterobtainingapprovalandThePeople'sRepublicofChinaEmploymentLicenseforForeigners(hereinafterreferredtoasthe"EmploymentLicense").Article6Theposttobefilledbytheforeignerrecruitedbytheemployershallbethepostofspecialneed,apostthatcannotbefilledbyanydomesticcandidatesforthetimebeingbutviolatesnogovernmentregulationsNoemployershallemployforeignerstoengageincommercializedentertainingperformance,exceptforthepersonsqualifiedunderArticle9(3)oftheseRules.Article7AnyforeignersseekingemploymentinChinashallmeetthefollowingconditions:(1)18yearsofageorolderandingoodhealth(2)withprofessionalskillsandjobexperiencerequiredfortheworkofintendedemployment;(3)withnocriminalrecord;(4)aclearly-definedemployer;(5)withvalidpassportotherinternationaltraveldocumentinlieuofthepassport(hereinafterreferredtoasthe"TravelDocument").Article8ForeignersseekingemploymentinChinashallholdtheEmploymentVisasforthewentry(Incaseofagreementformutualexemptionofvisas,theagreementshallprevail.),andmaywokwithinChineseterritoryonlyaftertheyobtaintheEmploymentPermitforForeigner(hereinafterreferredtoasthe"EmploymentPermit")andtheforeignerresidencecertificateForeignerswhohavenotbeenissuedresidencecertificate(i.e.holdersofF,L,CorG-typesvisas),andthosewhoareunderstudyorinterimprogramsinChinaandthefamiliesofholdersofEmploymentVisasshallnotworkinChina.Inspecialcases,employmentmaybeallowedwhentheforeignerchangeshisstatusatthepublicsecurityorganswiththeEmploymentLicensesecuredbyhisemployerinaccordancewiththeclearanceprocedures1undertheseRulesforeignerschangeshisstatusatthepublicsecurityorganswiththeEmploymentLicenseandreceiveshisEmploymentpermitandresidencecertificate.TheemploymentinChinaofthespousesofthePersonnelofforeignernbassies,consulates,representativeofficesoftheUnitedNationsSystemandotherinternationalorganizationinChinashallfollowtheProvisionsofMinistryofForeignAff...
