I(Legislative acts)DIRECTIVESDIRECTIVE 2010/35/EU OF THE EUROPEAN PARLIAMENT AND OF THE COUNCILof 16 June 2010on transportable pressure equipment and repealing Council Directives 76/767/EEC, 84/525/EEC,84/526/EEC, 84/527/EEC and 1999/36/EC(Text with EEA relevance)THE EUROPEAN PARLIAMENT AND THE COUNCIL OF THE EURO-PEAN UNION,Having regard to the Treaty on the Functioning of the EuropeanUnion, and in particular Article 91 thereof,Having regard to the proposal from the European Commission,Having regard to the opinion of the European Economic andSocial Committee (1),After consulting the Committee of the Regions,Acting in accordance with the ordinary legislative procedure (2),Whereas:(1)Council Directive 1999/36/EC of 29 April 1999 on trans-portable pressure equipment (3) was adopted as a first steptowards enhancing transport safety for transportable pres-sure equipment, whilst ensuring the free movement oftransportable pressure equipment in a single transportmarket.(2)In the light of developments in transport safety, it is nec-essary to update certain technical provisions of Directive1999/36/EC.(3)Directive 2008/68/EC of the European Parliament and ofthe Council of 24 September 2008 on the inland transportof dangerous goods (4) extended the application of theprovisions of certain international agreements to covernational traffic in order to harmonise the conditions underwhich dangerous goods are transported by road, rail andinland waterways across the Union.(4)It is therefore necessary to update the provisions of Direc-tive 1999/36/EC accordingly to avoid conflicting rules, inparticular as regards conformity requirements, conformityassessment and conformity assessment procedures in rela-tion to transportable pressure equipment.(5)In order to enhan...
