TrademarkLawofthePeople'sRepublicofChina(the2ndamendededition)OrderNo.59[2001]ofpresidentOctober27,2001(Adoptedatthe24thmeetingoftheStandingCommitteeoftheFifthNationalPeople'sCongressonAugust23,1982,AmendedaccordingtotheDecisiononAmendingtheTrademarkLawofthePeople'sRepublicofChinaatthe34thSessionoftheStandingCommitteeofthe7thNationalPeople'sCongressonFebruary22,1983forthefirsttime,AmendedaccordingtotheDecisiononAmendingtheTrademarkLawofthePeople'sRepublicofChinaatthe24thSessionoftheStandingCommitteeofthe9thNationalPeople'sCongressonOctober27,2001forthesecondtime)ContentsChapterIGeneralProvisionsChapterIIApplicationforTrademarkRegistrationChapterIIIExaminationandApprovalofTrademarkRegistrationChapterIVRenewal,AssignmentandLicensingofRegisteredTrademarksChapterVDeterminationofDisputesConcerningRegisteredMarksChapterVIAdministrationoftheUseofTrademarksChapterVIIProtectionoftheRighttoExclusiveUseofaRegisteredTrademarkChapterVIIISupplementaryProvisionsChapterIGeneralProvisionsArticle1ThisLawisformulatedforthepurposeofimprovingtheadministrationoftrademarks,protectingtherighttoexclusiveuseoftrademarksandencouragingproducersandoperatorstoguaranteethequalityoftheirgoodsandservicesandmaintainthereputationoftheirtrademarks,soastoprotecttheinterestsofconsumersandofproducersandoperators,andtopromotethedevelopmentofthesocialistmarketeconomy.Article2TheTrademarkOfficeoftheadministrativedepartmentforindustryandcommerceundertheStateCouncilshallbeinchargeofthetrademarkregistrationandadministrationthroughoutthecountry.TheadministrativedepartmentforindustryandcommerceundertheStateCouncilshallestablishaTrademarkReviewandAdjudicationBoardtoberesponsibleforhandlingtrademarkdisputes.Article3RegisteredtrademarksarethosethathavebeenapprovedandregisteredbytheTrademarkOffice,includingcommoditytrademarks,servicetrademarks,collectivemarksandcertificationmarks;trademarkregistrantsshallbeentitledtotherighttoexclusiveuseoftheirtrademarksandshallbeprotectedbylaw.CollectivemarksusedinthisLawshallrefertothemarksthatareregisteredinthenameofgroups,associationsorotherorganizationsandthatareprovidedtothemembersofthesaidorganizationsforbusinessactivityuse,thustoindicatethemembershipoftheusersinthesaidorganizations.CertificationmarksusedinthisLawshallrefertothemarksthatarecontrolledbytheorganizationswithsupervisingpoweroversomekindofcommoditiesorservicesyetareusedbytheunitsorindividualsapartfromthesaidorganizationsontheircommoditiesorservices,thustocertificatetheorigins,rawmaterials,manufacturingmethods,qualityorotherspecificcharacteristicsofthesaidcommoditiesorservices.ThespecialmattersconcerningtheregistrationandadministrationofcollectivemarksandcertificationmarksshallbeprovidedforbythedepartmentforindustryandcommerceundertheStateCouncil.Article4Anynaturalperson,legalpersonorotherorganizationthatneedstoacquiretherighttoexclusiveuseofatrademarkforthecommoditiesitproduces,manufactures,processes,selectsormarketsshallfileanapplicationforcommoditytrademarkregistrationwiththeTrademarkOffice.Anynaturalperson,legalpersonorotherorganizationthatneedstoacquiretherighttoexclusiveuseofatrademarkfortheserviceitemsitprovidesshallfileanapplicationforservicetrademarkregistrationwiththeTrademarkOffice.TheprovisionsofthisLawrelatingtocommoditytrademarksshallbeapplicabletotheservicetrademarks.Article5Twoormorenaturalpersons,lega...
