我国交通执法中自由裁量权研究

本科论文摘 要交通执法中的自由裁量权是现代交通执法发展的必然趋势，也是现代社会发展的必然要求，随着社会经济的发展，交通执法中的自由裁量权越来越重要。交通执法与人们的生活密切相关，而交通执法中自由裁量权的行使是交通执法的关键，一方面可以弥补法律的的不足，另一方面可以提高交通执法的效率、保证交通执法的质量。但交通执法自由裁量权是一把双刃剑，运用得当可以确保执法质量，但运用不当则会损害公民的合法权益，因此有必要对其进行规制。本文通过对我国交通执法中自由裁量的研究，分析其中出现的问题，为问题的解决提供建议，保证交通执法自由裁量权的规范行使。关键词：交通执法；行政执法；自由裁量权；规制本科论文AbstractThe discretion in traffic law enforcement is an inevitable trend of the development of modern traffic law enforcement and also an inevitable requirement of the development of modern society. With the development of social economy, the discretion in traffic law enforcement becomes more and more important. Traffic law enforcement is closely related to people's lives, and the exercise of discretion in traffic law enforcement is the key to traffic law enforcement. On the one hand, it can make up for the deficiency of laws, on the other hand, it can improve the efficiency of traffic law enforcement and guarantee the quality of traffic law enforcement. However, the discretionary power of traffic law enforcement is a double-edged sword. Proper use can ensure the quality of law enforcement, but improper use will harm the legitimate rights and interests of citizens, so it is necessary to regulate it.
