农民工劳动权益的法律保障 法学专业

1摘 要农民工劳动权益的法律保障涉及就业权、劳动报酬权、职业安全权等劳动问题。农民工劳动权益保障立法不完备；农民工劳动权益保障执法不力，劳动监察体制存在弊端；司法保障不足都是导致农民工劳动权益保障问题的重要原因。要想解决问题，必须完善农民工劳动权益保障立法，制定专门保护农民工劳动权益的法律；加强农民工劳动权益保障执法力度，强制设立各地劳动监察部并完善劳动监察方式；完善农民工劳动权益的司法保障。只有全方位完善相关法治系统，方能改善农民工劳动权益保障不到位的问题，方能促进社会长治久安。关键词：农民工；劳动权益；法律保障2ABSTRACTThe legal protection of migrant workers ’labor rights involves labor issues such as the right to employment, labor compensation, and occupational safety. The reason is that the legislation of migrant workers' labor rights protection is incomplete; the enforcement of migrant workers' labor rights protection is weak, and the labor supervision system has drawbacks; and the lack of judicial protection is an important cause of migrant workers' labor rights protection. To solve the problem, we must improve the legislation on the protection of migrant workers ’labor rights, formulate laws specifically protecting the migrant workers’ labor rights and interests; strengthen the enforcement of migrant workers ’labor rights protection, enforce the establishment of local labor inspection departments and improve labor supervision methods; Judicial guarantees.
