I摘 要大数据时代背景下泄露、非法利用个人信息的现象日趋严重，因此对个人信息的保护越来越受到重视。目前我国对个人信息保护的现状是在刑法领域比较全面，而民法保护力度不够。本文从个人信息的概念和特点出发，结合国内外对个人信息的保护现状及大数据下我国个人信息民法保护方面存在的问题，提出了“《个人信息保护法》+《民法典分则》”的保护模式、加强知情同意原则和完善个人信息保护救济措施等建议。关键词：个人信息；大数据；民法保护AbstractUnder the background of the era of big data, the phenomenon of personal information being leIIaked and illegally used is becoming more and more serious.
