儒家思想与中国现代法治的出路学位论文

AbstractConfucianism is the thought of Chinese orthodox feudality in ancient times. It has a series of opinions about vindicating "rule of li", advocating "the rule of virtue", attaching importance to "the rule of man". And those have had a deep impact to china. Confucian concept evolved into Chinese society ＇ s ethics. Chinese modern rule of law development is inseparable from the history, but there is a lot of contradictions between Confucianism and the modern rule of law. So finding the confluent factors from those certainly is a good method of modern rule of law development in China. The article analyzed the value and possibility of Confucianism for the modern rule of law with Confucianism , research the best way to developing the modern rule of law with Confucianism.Keywords: Confucianism；modern rule of law；the rule of virtue；the rule of man儒家思想与中国现代法治的出路以周礼为基体和源泉的儒家思想在中国的方方面面都根深蒂固，儒家精神仿佛嵌入整个民族的文化中、溶于中国民众的血液中，无时无刻对中国政治、经济、社会、人们日常生活产生着无法忽略的影响。然而，自从 19 世纪中叶开始，伴随着西洋的军事与经济对中国的冲击，统治着中国的数千年的儒家文化也有史以来第一次面临另一种更强有力的异质文化咄咄逼人的挑战。在儒家思想与作为现代文明标志之一的西方法治之间的冲突中挖掘出儒家精神于现代法治存在的可能性，探寻儒家本质中对现代法治进展有积极意义的因素，立足于儒家精神之上摸索中国法治的出路，对中国现代法治的进展有着极其重要的意义。一、儒家思想的基本宗旨（一）封建社会儒家思想的形成及进展春秋战国时期是中国古代由奴隶制社会过渡到封建社会的大变革时期，也是古代各种思想最活跃的时期。这个时期各种思想流派不断涌现，代表各阶层、各派政治力量的知识分子都企图根据本阶级或本集团的利益和要求，分别提出他们对政治、社会秩序的看法，并提出达到他们的理想的方法。以孔子为创始人的儒家也在这时产生，是当时“百家争鸣”中最早形成的一个最大学派。①儒家的思想是继承西周以来的...
