本科毕业设计-浅论我国忠实义务立法的完善

中文摘要近年来，随着社会的不断进展和进步，我国的婚姻状况出现了很多新问题，因重婚、姘居、通奸、包二奶等行为引起的离婚案件一直呈上升趋势，这给家庭稳定和社会秩序带来了极大的危害。鉴于此，我国《婚姻法》修订的其中一个重点就是夫妻忠实义务的确立，这对于法律规范和完善婚姻制度、有效制止社会不正之风、填补损害和抚慰受害者上有着非常积极的意义，本文对设立夫妻忠实义务的具体意义、实施的局限和赔偿制度进行了分析。侧重分析了违反夫妻忠实义务应承担的法律责任和违反夫妻忠实义务应承担的损害赔偿。关键词：婚姻；夫妻忠实义务；离婚；损害赔偿AbstractIn recent years，along with society's unceasing development and progress，our country marital status had very many new problems，because of the bigamy，the illicit cohabitation，the adultery，having a concubine and so on behavior causes divorce cases continuously rising，this gives family stability and the social order brought great harm．In view of this，our country＂Marriage law＂revised one of the emphasis is the husbands and wives faithful duty's establish , this regarding standard and consummation marriage system，effectively stops the social unhealthy tendency，fill damage and to comfort on the victim have the extremely positive significance，this paper analyzed establish husbands and wives faithful duty’s the specific meanings，implementation limitation and compensation system．Focuses on analyzing the violation of husband and wife faithful obligations shall bear legal responsibility and breach of duty of loyalty of husband and wife should compensate for damages.
