AbstractCivil Protest System is a system of legal supervision proceedings which is exercised by People’s Procuratorate. It is a system for supervision of judicial activities for the people's court in civil cases. The system is not only consistent with China's national conditions but also an important one which is the maintenance of civil justice and judicial authority. However, China’s nowadays Civil Protest System is not consummate, legislation needs to be improved. There are divisions appear between procuratorate and the court, which leeds to a failure and limited effect during the Civil Protest. This article combine Civil Procedure Theory and China's legal system concept, demonstrate the rationality and necessity of Civil Protest System’s existence.Focus on analysing the value of Civil Protest System. In order to achieve the legislative, the analysis should be base d on the combination of judicial practice.
