中文摘要 近年来，关于见义勇为的事件，屡有发生，各媒体都有相关的报道。这不仅是对见义勇为行为的肯定，还起到了鼓舞公民与正在进行的不法侵害作斗争的作用，从而保障社会公共利益及公民的合法权利免受正在进行的不法侵害，这就是正当防卫制度的作用所在。然而，在司法实际中，对于正当防卫制度聚讼纷纭，这种混乱不一的状况在很大程度上影响了公民正当防卫权的行使，立法者所期望的正当防卫“以正压邪”之社会效果更是难以付诸实现。本文通过从正当防卫制度的价值层面发表见解，对存在的缺陷等问题进行探讨，并结合我国刑法关于正当防卫内容的规定及借鉴大陆法系的做法，有针对性的对正当防卫制度的完善提出了自己的观点和建议，由此更好的实现正当防卫制度的立法精神。关键字：正当防卫；防卫过当；不法侵害；假想防卫；大陆法系 AbstractIn recent years, about the event, heroic sometimes occur, the media have related reports.
