AbstractIn today's localization and internationalization of legal issues is still theme of the times, this article will examine the revised law in the late Qing to Chang Chih-tung as the representative of the "ceremony sect" and to Shen, represented by the "legal faction" of the different points of view below, explore their inner thought; thus thought to interact with the system perspective on China's modern process, in particular the process of modernization of the legal impact of modernization and the rule of law and then think whether the established tradition of integration.Key words: Late Qing Dynasty; "etiquette dispute"; legal faction; ceremony denomination论清末“礼法之争”1748 年法国伟大的启蒙思想家、法学家孟德斯鸠，在其发表的《论法的精神》中曾有过这样的一段表述：“为某一国人民而制定的法律，应该是非常适合于该国的人民的；所以假如一个国家的法律竟能适合于另一个国家的话，那么只是非常凑巧的事。”①先且不论孟德斯鸠其对法的移植可行性的严重低估对与否，但法的移植现象却是真实存在的。当人类历史跨入 18、19 世纪，以欧美为代表的西方各国已基本确立资本主义，并且取得长足进展；在清王朝统治下的中国已日渐衰落，1840 年，中英鸦片战争的爆发及《中英南京条约》的签订，使得清政府面临着“三千年未有之变局”，而对于一个拥有悠久历史的伟大民族来说，更是一场“噩梦”的开始。至晚清始，中国法律便经历了一次前所未有的变迁，既中国法律的近代化，近代中国法律的进展表现为三个部分的变革：法律价值观、法律文本、法律机构。而这一切以清末修律为始端，随之而来产生了一场深远的影响着中国法律的大辩论——清末“礼法之争”。清末“礼法之争”其核心便是法律价值观之争；而东西方不同法律价值观的此次碰撞又会给予我们后人什么样的启示，笔者将通过审视清末修律中以“礼教派”与“法理派”间不同观点的基础上，探究他们的内在思想；从而以思想与制度互动的角度讨论其对中国近现代进程，尤其是法律近代化过程中产生的影响，进而思考在法治现代化与固有传统融合的问题。一、清末“礼法之争”的背景与产生（一）清末“礼法之争”的背景晚清之前的古...
