本科毕业设计-试论我国新闻立法的完善

AbstractWith the social and economic development of our society,the gradual advancement in citizens’awareness of their legal consciousness，as well as the protection of there rights，many welcome changes have occurred in our country’s joumalism．However,it also faces a lot of problems which is few under the condition of the planned economy ． The media-related tort is one of them．Under the present law system，Media-related torts appear constantly,which expose the conflicts between press freedom and news supervision，between individual privacy and the right to know,and between the individual interests and the public interests,and expose the defect of our legislation about media-related torts.This paper started with analyzes the present situation of the media and its reason,draw on the experience of media-related torts from abroad,and finally puts forward the preventive solutions.Key words: media-related torts；freedom of the press；private rights试论我国新闻侵权立法的完善改革开放以来，中国社会在政治、经济、文化方面发生了深刻的变化；随着现代科学技术的进步与进展，形式多样的传播媒介也相继出现，如报纸、杂志、广播、电视、网络等，同时随着传播技术的不断进展和传播手段的不断变化创新，各种的传播媒介逐渐深化到我们的日常生活当中，并成为我们日常生活当中不可或缺的一部分，在很大程度上影响着人们的价值观与理念。同时，由于新闻能产生强大的社会舆论，随之产生巨大的社会影响，使人们对它的重视程度逐步加强，由于传播媒介在传播新闻的过程中往往会参杂制作者个人的情感、观点等主观原因，以至于出现失实的新闻报道，人民的法律意识不断增强，学会对自我的合法权益和利益用法律方式进行保护，近年来，有关于新闻官司的案件不断地增多，新闻侵权的现象日益成为一种普遍的社会现象，对社会不同阶层的的民众切身利益的影响也越来越明显；因此，笔者从新闻侵权立法制度的价值分析、我国新闻侵权立法中存在的问题及原因、对国外新闻侵权立法的借鉴，并提出对我国新闻侵权立法的建议。一、新闻侵权的定义及其与...
