本科毕业设计-试论我国网上交易消费者权益保护

AbstractAs a new type of transaction in the market, online trading brings the convenient, abundance goods for sale and news of service to people, but, at the same time, it also increases the opportunities of consumers suffering from damage and severely violates the legal rights of the consumers. Therefore, the protection for consumers online trading is very important. Based on the analysis the shortcomings of China’s online transactions to protect the interests of consumers, combined with advanced legislative experience, in this paper, a number of recommendations are made to protect the interests of consumers of the online transactions in China.Key words: online trading; the protection for the interests of consumers; claims for compensation for damage.试论我国网上交易消费者权益保护随着信息技术特别是网络技术的不断进展，网络经济给人们的生活带来了巨大的影响，网上交易作为一种新型的交易方式，为人类提供了全新的商业交易方式。它突破了商业进展的传统惯例，呈现出爆炸性增长的趋势，但由于受到相关网络环境、政策法律环境、消费意识以及市场环境的制约，这也给我国网上交易消费者权益保护提出了难题。一、网上交易和消费者权益保护的特别性网上交易不同于传统交易，交易主体是以虚拟的状态存在的，即卖方在网上交易中仅以虚拟的方式存在，真实名称、地址在网上并不明示显现，网上交易一切都通过网络进行，买方卖方互不见面。与传统交易相比，网上交易存在着特别性。（一）交易主体的复杂化在传统的“一手交钱一手交货的”交易环境下，交易主体一般只涉及两方：经营者和消费者。当经营者提供商品或服务侵害到消费者权益的时候，对承担责任的主体是比较容易的认定的。而网上交易涉及的交易主体的范围远不止这些。网上交易是利用网络通信进行的非面对面的交易，几乎所有的交易记录和意思表示都表现为电子数据。为了保证网上交易的安全和效益，需要许多主体参加货物交易或服务中。网上交易一般涉及到的主体除了经营者和消费者之外还包括网上交易平台提供者、认证机构、金融服务机构和货物运输机构等。（二）创建了虚拟的商业环境在传统交易中，当事人之...
