In real life, divorce damage compensation system is not perfect enough, it has caused widespread concern in the whole society because of threatening to the legal rights of the parties , divorce damages system has become essential in today's society theory and judicial practice problems. This paper put forward the necessity of perfecting divorce damage compensation system , analyze the phenomenon of hurting the parties during the marry.Pointe out the disadvantages of China's current system of divorce damages. For these deficiencies, combined with our practical and the advanced foreign related systems, take out specific measures so that protect marriage more effectively, and promote our family sustained, stable and healthy development.Key words：divorce damage；marriage；damage compensation；couples试论我国离婚损害赔偿制度的完善随着社会的进步，人们婚姻观念的转变，及其对婚姻品质的追求，“包二奶”“第三者”“分居”的现象与日俱增，加剧了夫妻的矛盾，抛高了离婚率，破坏了家庭关系，冲击着社会道德伦理秩序，严重的扰乱了社会的稳定，造成了法律的灰色地带。虽然我国婚姻法第 46 条对离婚损害赔偿制度做了相应的规定，但与现实情况还存在一定的差距，该法条不能充分的照顾到各方面的权益。因此，讨论离婚损害赔偿制度的完善是十分必要的。一、完善我国离婚损害赔偿制度的必要性重婚、实施家庭暴力、有配偶者与他人同居、虐待、遗弃家庭成员等一系列破坏婚姻家庭的情形出现，导致我国的离婚率持续不断上升，使夫妻矛盾不断升级、关系恶化从而走向婚姻的尽头。这些行为不仅冲击着我国一夫一妻制，而且严重动摇了我们国家和社会的根基；它不仅严重破坏了我国婚姻家庭关系的稳定，造成无过错配偶一方人身、财产等合法权益遭受损害，而且严重破坏了我国的社会风...
