本科毕业设计-试论我国表见代理制度的完善

AbstractApparent is one of the most important systems of the agency system of civil law. It can fairly guaranty the legitimate interests of all the parties. In many countries, it has been confirmed through jurisprudence and doctrine. There also exists its theoretical basis. This system can protect the legitimate interests of the third party in good faith, ensure the transaction security of all parties, maintain the goodwill of the agency system, save the resources of judicature, and improve the efficiency of the society and economy. And it is also really needed in the development of socialist market economy and judicial practice in our country. The apparent is first provided in the contract law of the People’s Republic of China. As the apparent established in China not so long, there are so many issues have exposed in judicial practice. So it is really needed for us to prefect our country’s apparent system.
