本科毕业设计-试论我国行政信息公开制度的完善

AbstractThe Administrative information openness system originated in Sweden and developed rapidly after the economic depression and the Second World War. In China, along with the establishment of the market economy system and the government management system transformation, the administrative information openness system develops gradually. By analyzing the significance and the present situation of the administrative information openness system, this paper points out the necessity and importance of establishing the system in China .Finally, the article will make the feasibility analysis of executing the system in our country and put forward concrete suggestions on it by taking examples from the research theory and practice experience of foreign administrative public system.Key words: The administrative information openness system, The defects, The feasibility, Specific Suggestions.试论我国行政信息公开制度的完善所谓行政公开信息制度，是指用以法律规范行政权的行政程序，除涉及到国家机密、商业秘密或者个人隐私外，应当一律向公民和社会公开。公民因此可以通过参加行政程序维护自己的合法权益；社会民众因此可以通过公开的行政程序，监督行政机关依法行使行政权力的一种法律制度。①随着信息社会的来临，传统的工业文明逐步被信息文明所取代。在信息社会里，行政信息的公开化已成为公众的普遍需求，行政信息公开制度已成为现代民主国家的一项必备制度。它不仅成为民众参政、议政的重要前提，而且对预防、抑制腐败，提倡廉政，提高国家行政机关的工作效率有着极其重要的作用。而我国关于行政信息公开制度的相关配套法规还不完善，所以在理论和制度层面上，还存在较大缺陷。对此，讨论并着力于完善行政公开信息制度是一项十分有价值的理论实践。一、完善我国行政信息公开制度的意义（一）完善行政信息公开制度是推动依法行政的重要手段依法治国的根本在于依法行政，实行行政信息公开，将司法行政的法律法规、行政相对人的权利和义务、法律服务机构及其人员的职责等内容如实公示，增强了法律服务人员的执法透明度，有利于对其执法行为实行...
