Based on the Legal Control of Administrative Discretion theoretical analysis, the face of domestic and international legislation and the discretion of the problems of abuse, combined with the actual situation, put forward on this basis the corresponding Improvement.Key Words：Administrative Discretion；Administrative penalty；Abuse of power试论我国行政裁量权的法律控制行政裁量权是行政权力的重要组成部分，也是行政权力中最显著、最活跃的一部分权力，是行政主体提高行政效率之必需的权限，它能使行政执法者审时度势、灵活机动、大胆地处理问题。行政自由裁量权在其运行过程中，不可避开地产生两方面的作用：一方面是积极的能动作用，即行政自由裁量权的运行能起到维护公共利益，维持公共秩序，提高行政效率，满足社会需要，实现国家权能的作用；另一方面，对行政相对人的权益可能造成侵害，从而对行政法治构成威胁。同时，行政裁量权又是必须加以控制的权力，否则将物极必反，所以进一步讨论与探讨行政裁量权及其法律控制是非常必要的，具有非常重要的意义。一、我国行政裁量权法律控制的意义权力的授予与控制总是同时存在的，行政裁量权也不能例外。英国著名法官霍尔斯伯勋爵指出：“自由裁量是指任何事情应在当局自由裁量权范围内去行使，而不是根据个人观点行事，应根据法律行事，而不是随心所欲。它应该是法定的和固定的，而不是独断的、模糊的、幻想的，它必须在所限制的范围内行使”。所谓行政裁量权的法律控制，是指行政主体在法律、法规规定的范围和幅度内，对具体行政行为的自行决定权，即对行为范围、方式、种类、时限等的选择权。行政裁量...
