本科毕业设计-试论我国贪污罪刑罚立法的完善

AbstractCorruption and crime is important manifestation of the phenomenon of corruption in the country, one of its corruption and crime, a serious harm to society to become China's reform and opening up and building a serious obstacle to career development, to combat and curb corruption and crime into the party and the people of the arduous task of protecting and promoting our spiritual civilization, political civilization and material civilization of great significance. First analyzes the significance of our corruption legislation, particularly in the fight against crime and corruption in the sentence optimal range, followed by the analysis of corruption in China Legal Sentence set status and shortcomings, and learn from foreign countries against corruption penalty provisions, the specific proposed criminal penalties should be introduced, there should be eligible for punishment, and should be an appropriate extension of liberty, should abolish the death penalty and so on.Key words: Corruption ； Penalty rate ； Qualification penalty ； Life sentence试论我国贪污罪刑罚立法的完善从原全国人大副委员长成克杰、原安徽省副省长王怀忠等省级干部的贪污案 ，到“邱晓华”、“郑筱萸”之流，再到中国足球反赌风暴揪出的中国足协掌门人南勇、杨一民贪污门事件。严峻的现状一次又一次地摆在国人的面前，如何才能遏制贪污腐败的进展态势成为了人们广泛热议的问题。虽然我国刑法确立了关于贪污罪法定刑的规定，但是贪污犯罪的愈演愈烈说明我们必须要对现行刑法进行反思，才能找出问题的症结所在。笔者认为，贪污罪的法定刑存在缺陷，使其遏制贪污犯罪现象的功能起不到应有的效果。因此，完善我国贪污罪法定刑，正是解开这一症结的最佳良药。一、完善我国贪污罪刑罚立法的意义（一）有利于落实依法治国的治国方略“反腐败是关系党和国家生死存亡的严重政治斗争。”贪污犯罪是我国腐败现象的重要表现之一，贪污犯罪以其对社会严重的危害性成为我国改革、开放、建设事业进展的严重阻碍，打击和...
