本科毕业设计-试论我国辩护律师诉讼权利的保障

中文摘要在人们的法制观念日益增强和法治日益推动的今日，辩护人，不再是陌生的法律概念，辩护律师的重要性也越来越受到大众特别是当事人的重视，有鉴于此，辩护律师诉讼权利的保障不容忽视。本文首先提出对保障辩护律师的诉讼权利的必要性，通过分析在刑事诉讼中辩护律师所遇到的阅卷、调查取证、会见等问题，指出目前我国对于保障辩护律师的诉讼权利的诸多不足与缺陷。针对这些不足与缺陷，提出相关的完善的建议，以期使辩护律师更加有效地进行辩护工作，保障当事人的合法权益，推动我国刑事诉讼的进步和改革。关键词：辩护律师；诉讼权利；阅卷权；会见权；调查取证权 AbstractToday, awareness of law is almost in everyone’s mind, and Rule of law is improving.Defender plays an important rule in the criminal proceecdings，besides, defence counsel is no longer a strange concept to people, particular to the litigants.So, it’s not appropriate to ignore the procedural right of the defence counsel ． Firstly, the paper puts forward to the importance of procedural right of the defence counsel,then analyzes the difficult of the defence counsel in the criminal proceedings,such as reviewing cases files and documents,interviewing.After that,the paper points out the advices according to the shortage mentioned.By poniting out the advices,helps the defence counsel defend more effectively.It is benefit to safeguard the rights of the party interested and improving the criminal proceedings in the courntry.Key words:defence counsel ； procedural right ； the right of reviewing cases files and documents ； the right of interviewing ； the right of investigatin试论我国辩护律师诉讼权利的保障辩护律师在刑事诉讼中所扮演的是维护犯罪嫌疑人、被告人合法权益的代言人的角色，他需要充分发挥法律专业经验优势，主动而独立地根据法律给予辩护律师的一系列权利，从事实和法律两个方面为维护犯罪嫌疑人、被告人的合法权益展开刑事辩护。现行法律给予了辩护律师一系列诉讼权利，使其能够发挥其独立作用，而不再局限于简...
