本科毕业设计-试论提单欺诈及其对策

中文摘要提单在国际贸易中扮演着十分重要的角色，为国际贸易带来许多便利和进展，但随之而来的提单欺诈案件也逐渐增多。提单法律制度的不足与缺陷，难以应付日益增长的提单欺诈现象，因此给参加者造成严重的损失。有效地打击提单欺诈活动，进一步完善提单制度本身，是摆在世界各国特别是进展中国家面前的一个不容忽视的问题。我国是一个贸易大国，海运经济在我国国民经济中占有举足轻重的地位。因此，对提单欺诈及其对策的讨论，对我国的经济进展具有重大意义。本文论述了提单欺诈，并提出了相应的防范措施。关键词：提单欺诈；立法；司法实践 AbstractThe bill of lading plays a very important role in international trade ， which brings much convenience and development to the international trade，but the bill of lading fraud is increasing together .The shortages and defects of bill of lading system is hard to cope with the increasing bill of lading of fraud ， so that it makes participants caused heavy losses. Effectively striking bill of lading fraud and further improving the bill of lading system itself ， is a facing problem that not allowed to ignore in the countries of the world ， especially in developing countries. China is a leading trader，and shipping economy plays an important role in China's national economy. Therefore ， the research and the countermeasures of bill of lading fraud is of great significance to the development of China's economy. This paper discusses the bill of lading fraud，and puts forward some corresponding preventive measures.
